I’m just worried about our perception, said State Senator Reynold Nesiba, a Sioux Falls Democrat, “because I think, generally, South Dakotans are a welcoming people.” Nesiba was speaking to reporters about South Dakota House Bill 1217, a measure intended to limit transgender participation in sports. The measure would be uncontroversial in saner times, or at least those during which most people were still aware of the basic physical differences between the sexes. But we no longer live in sane times. […] The shadow of Amazon’s proposed Sioux Falls fulfillment center looms in the background of Nesiba’s comments. “I’m frankly a little worried about Amazon,” he said, presumably due to the company’s advocacy of LGBTQ ideology which, no doubt, suggests the possibility of Amazon pulling the plug on a Sioux Falls operation. Nesiba shouldn’t have worried, however, because, for the second time, Republican Governor Kristi Noem has signaled against a bill intended to protect the sexes. South Dakota Gov. Kristi Noem has rightly made a national name for herself courageously standing, almost alone, for science, sanity, and constitutional rights during the COVID panic. Yet it appears she’s hoping to use the goodwill she earned through this courage to hide her cowardly and deceptive choices about transgender politics. Like the governors who should have learned from her example on lockdowns and have instead doubled down on their leadership failures, Noem could decide to come clean, change course, and pursue common-sense policies about sex. Or she could continue to eviscerate her credibility and earned goodwill by selling out her own constituents on behalf of sexually debauched corporatists, as Mike Pence did when governor of Indiana. Rolling over to leftists in the culture war is certainly what voters have come to expect from politicians with an R after their names not named Donald Trump. But it also would be what Trump taught voters we don’t have to put up with anymore. Any standard-bearer of today’s right must fight the culture war, not hide from it. Unless reversed, her capitulation has disqualified Noem from national leadership. […] Noem repeatedly claimed she was scared of lawsuits brought by the NCAA, parents of daughters forced to compete against transgender boys, and unnamed others over this bill. She attributed this alleged fear to claims from “legal scholars.” . . . By “legal scholars,” does Noem mean her chief of staff, Tony Venhuizen, a lawyer who also sits on the board of the Sioux Falls Chamber of Commerce, which listed H.B. 1217 as a “tier 1” priority “of the highest importance” to oppose this legislative session? Or perhaps she means her “top advisor,” Matt McCaulley, a lawyer and lobbyist whose “clients include Sanford Health, which owns Sanford Sports Complex, a Sioux Falls arena that hopes to lure NCAA tourneys”?

Jones & Buckham: GOP Senators Roll for Biden Nominations
In November, President Trump earned a record-setting 74,216,154 votes. But as plainly exhibited by extensive and resounding down-ticket victories, the enthusiasm was not just for old 45 himself. It was also for the robust and realigned conservative agenda—one focused on prioritizing the national interest and American families—that he helped to forge and advance. Alas, rather than now defend and fight for that agenda, Republican Senators, who we elected—and, in some cases, reelected—are scampering away, and hoping we won’t notice their cowardice. Yet we do notice. In particular, they’re rolling over for Biden’s cabinet nominees, many of whom are beyond palatable for even progressive tastes, as clearly demonstrated in original research conducted by the American Accountability Foundation. Dave Catanese of McClatchyDC notes that seven Republican Senators have voted to confirm 80 percent or more of Biden’s cabinet picks. That’s astounding. Let these Senators be named: . . . Can you imagine what conservatives might have accomplished over the last four years if 80 percent of the Trump Administration’s initiatives had been backed by Congressional Republicans? Bauer: Wisconsin Assembly OKs election investigation
The Republican-controlled Wisconsin Assembly passed a resolution Tuesday to authorize an investigation into the 2020 presidential election that President Joe Biden narrowly won in the state. The resolution, opposed by Democrats, is needed to give the committee authorization if it decides to issue subpoenas to compel testimony and gather documents, said Rep. Joe Sanfelippo. He is vice-chairman of the Assembly elections and campaign committee that would conduct the probe. Biden defeated Donald Trump by fewer than 21,000 votes in Wisconsin. […] The resolution authorizing the investigation passed on a 58-35 party line vote, with all Republicans in support and all Democrats against. It passed after Republicans last month ordered an audit of the election results.

Frohnen: Bureaucracy of, by, and for the Smug
Since before the adoption of our Constitution, American lawyers have enjoyed surprisingly high status in a society devoted to self-government by an unruly people within their own communities. Our society enjoyed high levels of mutual trust despite the variety and restlessness of its people. This trust was protected and fostered by often self-educated journeymen lawyers. These lawyers helped forge agreements among commercial and political parties often too busy to write their own but too concerned that their handshakes be enforceable over time to do without written formalities. Lawyers also kept American restlessness in check when it came to public law by upholding a common law system that kept judges, litigants, and laws rooted in custom and practice, rather than abstract ideas or desires of the moment. Lawyers sometimes got a bit overawed by their own importance as statesmen and keepers of the common law. But their arrogance was kept in check by the fact that the real fortunes in a materialist society were made in business, and that lawyers had to make their own livings by tending to the business of others. As to the arrogance of political office, it was enhanced by corruption but tamped down somewhat by our democratic people’s demand for a significant amount of obedience as well as ceremonial obeisance. Sadly, the rise of the administrative state changed all this. Demand for lawyers exploded after the New Deal and especially the Great Society spawned a jungle of regulatory structures that persons and businesses required legal assistance to navigate. Lawyers dominated the writing, interpreting, and enforcing of the new regulations and so gained great power over government and business themselves. This power has proven intoxicating. Elite lawyers have come to see themselves and their work as the heart of civilized life rather than what it is, the necessary but quite limited set of tools and processes necessary to allow people to organize their own lives. The Department of Homeland Security is considering monitoring the travel of domestic extremists and expanding its use of the No Fly List, law enforcement sources told POLITICO. The discussions are part of the Biden administration’s strategy of treating domestic terror as a national security threat, and not just a law enforcement problem. They’re also part of broader conversations in government about how to use tools developed for the Global War on Terror to combat domestic extremism. . . . The department could begin analyzing the travel patterns of suspected domestic extremists, monitor flights they book on short notice and search their luggage for weapons, a senior law enforcement official told POLITICO. There have also been discussions about putting suspected domestic violent extremists — a category that includes white supremacists — on the FBI’s No Fly List, the official said. When suspected extremists travel internationally, officials may be more likely to question them before they pass through customs and to search their phones and laptops.

Phillips: Biden considering executive action on gun control, Psaki says
President Biden is considering executive action on gun control in the wake of two mass shootings in less than a week, White House press secretary Jen Psaki said Tuesday. Psaki did not specify what action Biden might take. “We are considering a range of levers, including working through legislation, including executive action,” Psaki told reporters. “That has been under discussion and will continue to be under discussion.”

Another opportunity to shore up their sagging “white terror threat” narrative is lost. A man murdered ten people in a Boulder, Colorado supermarket Monday. No details were immediately released about the shooter, but Leftist “journalists,” working from a photo of the shooter, seized upon the shooting to shore up their sagging narrative of “white supremacist terrorism.” There was just one problem: the massacre was actually, after a four-year hiatus, a new incidence of Islamic jihad on American soil. Even after the shooter’s name was revealed as Ahmad Al Issa (which is how he himself wrote it on his Facebook and Twitter accounts), establishment media reports continued to give his name as “Alissa,” which of course is a common first name for women in the U.S., and thus gives the impression that he is an American non-Muslim. Were “journalists” trying to obscure the fact that he is a Muslim migrant ISIS sympathizer? Of course they were. And that was after they had already decided that he was one of those “right-wing extremists” . . . [NOTE: It is interesting that during the Trump years there were no mass shootings but since Biden took office on January 20, 2021 we have already had two.]

Miller: The American media: the CCP’s useful idiots
There was a shooting spree at several massage parlors outside of Atlanta last week. The killer confessed in custody that his motivation was a combination of religious guilt and sex addiction. But the American media used the occasion to push a race-based explanation for the killings — an explanation that no investigators, including the FBI, have been able to prove thus far. By any and all factual indications, this was not a crime based on the victims’ race, but their occupation. American reporters ignore all that. Instead they sensationalize for a social-media audience of woke identitarians — and now the Chinese Communist party is getting in on the act. The CCP is employing the same talking points via their state media outlets as we see in our ‘free’ ones. The activist bent of our media empowers China to deflect blame on everything from their gross abusive treatment of the Uighurs in Xinjiang to the global pandemic.

Benton: State Legislatures Must Step Up And End The Mask Tyranny
The state of Oregon just descended further into lunacy by proposing that temporary rules on mask mandates be applied indefinitely. The proposal by Oregon Occupational Safety and Health (OSHA) would amend the current rule, set to expire on May 4, and require that the mask mandate remain in effect “until repealed or revised.” According to the proposal, such revisions would take place when it was “no longer necessary to address the COVID- pandemic.” Yet what exactly is meant by “necessary” is left to the imagination. So essentially Oregonians shouldn’t expect to be allowed to breathe freely again until unelected state health bureaucrats say they can. Until then, shut up and mask up. Oregon’s chilling proposal illustrates what is at risk if wily power-mongers succeed in exploiting the pandemic to impose a permanent health emergency state. […] At this point in the pandemic, the decision-making process to put an end to this sorry affair should not be left to the executive branch. Harris: Do We Need Mask Mandates?
The science suggests that more states should consider rescinding them. Joe Biden has counted on face masks to control the Covid-19 pandemic. On his first day in office, the president issued an executive order requiring masks on federal property and called for their widespread use for 100 days. More recently, the Centers for Disease Control has mandated masks on airplanes and mass transit, though most airlines and transit systems already require them. These recommendations mark the latest step in a thorough reversal of the pre-pandemic public-health consensus that masks are useless or counterproductive. Yet the evidence underlying this reversal turns out to be quite weak. Widespread use of masks throughout the United States and Europe has failed to stop massive pandemic waves in the fall and winter. Preliminary signs also suggest that mask mandates may be causing considerable harm. Several state governments have recently rescinded their mask mandates, and a look at the science suggests that more should consider following.

This book is also dystopian in spades, though in a matter-of-fact scientific fashion which makes a most compelling case about the probability of humanity’s demise.
