Haworth: Historic 6-3 Supreme Court Decision Narrows Anti-Hacking Law To Avoid Criminalizing ‘Commonplace Computer Activity’
In a 6-to-3 decision, the Supreme Court massively restricted the scope of the Computer Fraud and Abuse Act of 1986, a federal anti-hacking law. As reported by The Washington Post, “the majority of justices [said] the government’s ‘breathtaking’ interpretation of the statute could make criminals of ‘millions of otherwise law-abiding citizens.’” The case discussed whether Nathan Van Buren, a former Georgia police officer, violated the Computer Fraud and Abuse Act, which makes it illegal to “access a computer with authorization and to use such access to obtain or alter information in the computer that the accesser is not entitled so to obtain or alter.” […] The Supreme Court ruling reverses the decision of the U.S. Court of Appeals for the 11th Circuit, which “upheld Van Buren’s conviction and sentence of 18 months in prison.” Writing the majority opinion, Justice Amy Coney Barrett said that while Van Buren violated department policy, his behavior did not meet this definition, which “covers those who obtain information from particular areas in the computer — such as files, folders, or databases — to which their computer access does not extend.” […] The dissenting opinion was filed by Associate Justice Clarence Thomas, joined by Chief Justice John Roberts and Associate Justice Samuel Alito.

Moran: BOMBSHELL: U.S. State Department Tried to Block Investigation of Lab Leak at Wuhan
A report in Vanity Fair details actions by some members of the U.S. State Department to block efforts to investigate the origins of the coronavirus because the inquiry could open “a can of worms.” An internal memo sent to department heads by Thomas DiNanno, former acting assistant secretary of the State Department’s Bureau of Arms Control, Verification, and Compliance, warned “not to pursue an investigation into the origin of COVID-19.” The “can of worms” in question was the extensive funding by the U.S. government into the Wuhan Virology Lab’s “gain-of-function” virus research. It’s unclear whether DiNanno was concerned that an investigation would uncover evidence of a lab leak or the extent to which the U.S. was funding dangerous research.

On a recent trip to Colorado, I fired up the Atlas Shrugged audiobook. As I passed a line of train cars sitting empty and idle, noted the high gas prices, and listened to complaints about gas station supplier shortages, it occurred to me that Rand’s 1957 novel made a number of chillingly accurate predictions about our modern Wokestopia (i.e. Woke-dystopia). Like many immigrants who escaped communism, Rand knew firsthand the corrosive effect of politicizing the industries that supply and feed our economy. The central plotline of Atlas Shrugged follows the accelerating political corruption of American corporations. Rand painted a picture of a kind of corporate/leftist fascism that feels familiar to us in 2021. My child’s private Catholic elementary school recently welcomed a queer-promoting transgender advocate as part of its “antiracism” speaker series, declaring “diversity of identity and thought” is “a core characteristic of our Catholic faith.” The school insinuated the “transgender experience” and “defining ourselves for ourselves” can “result in more love,” and that such ideas are consistent with the sanctity of each individual as created in God’s image. The school’s embrace of anti-Christian, Marxist critical race theory was outrageous enough. The latest attempt, however, aims to pass off as Catholic an ideology that undermines Catholic teaching on family and sexuality while blaspheming the Creator and Judge. So I decided to yank my child out of the school and find a more theologically sound learning environment. This is the “liberal” Christianity that is corrupting our schools, universities, and churches at the hands of woke, misguided, or just poorly catechized administrators, teachers, and pastors. At its core, and under the guise of the pseudo-Christian virtues of progress and tolerance, the “liberal” Christian heresy entails the most destructive lie in the history of the church: a rejection of the self-denial and sacrificed demonstrated on road to Golgotha. Indeed, as such a posture distorts the very meaning of what it means to be Christian, it is the most pernicious threat confronting Christians today.

Malkin: Family Sovereignty Under Siege
Parents, beware. The dominion you have over your own children is under attack like never before. Teenage puppets for Big Pharma are being deployed on the ground and across social media airwaves to convince their peers to inject themselves with experimental drugs to allegedly prevent a disease for which the youth mortality rate is practically zero. “Do it for the herd” is the new rallying cry of designated “VaxTeen ambassadors” spearheading COVID-19 jab pop-up clinics at schools and churches nationwide targeting 25 million American children ages 12 to 17. VaxTeen is propped up by Google, the biotech lobby, and the Public Goods Project (a mysterious public health nonprofit backed by Silicon Valley, ad agencies and drug companies). As of last week, according to the Kaiser Family Foundation, more than 2 million 12-15-year-olds and 2.5 million 16-17-year-olds had received at least one COVID-19 vaccine dose. That’s about 12 percent and 31 percent of adolescents in each respective age group. Increasing those rates has nothing to do with a cure and everything to do with control and conformity. That is why “skeptical” and “hesitant” moms and dads—in other words, independent-thinking and responsible moms and dads—are viewed as obstacles and enemies to be overcome for the “public good.”

We neglect an essential element in the formation of citizens when we fail to supply young people with a full, accurate, and responsible account of their own country. That is what the formal study of American history should provide. Our knowledge of such things does not come to us automatically, by birth, or by cultural osmosis. The knowledge must be acquired and, once taken in, needs to be made our own, part of a shared consciousness and common memory. And that is something that we are consistently failing to do. The evidence is overwhelming and incontestable. In fact, the most recent test administered by the National Assessment of Educational Progress, sometimes called “The Nation’s Report Card,” shows continuing decline in (already-low) history and geography scores and flatlining in civics scores. The explanations adduced for this abysmal performance are many, and the barriers thrown up by the surrounding culture are formidable. But the bottom line is that we must recommit ourselves to the teaching of both history and civics—and to the recognition that the two belong together. As Eliot Cohen of Johns Hopkins University has aptly expressed it, “Without history, there is no civic education, and without civic education there are no citizens. Without citizens, there is no free republic. The stakes, in other words, could not be higher.”

The horrors of experimentation on aborted babies are too easily purged from our thoughts, but they should stoke our national conscience. This article is about gruesome subject matter. Child sacrifice strains the limits of moral relativity, yet too often abortion gets a pass. There are various arguments why, but at least it’s a debate. In contrast, most Americans are only semi-conscious of the use of aborted babies for medical experiments. Our tax dollars pay for it through the National Institutes of Health, but more often than not, we never hear about it. […] The comparison of abortion to child sacrifice is a common polemic, largely because there’s no satisfactory answer for why the two are fundamentally different. In many historical ritual murders across the globe, the purpose wasn’t purely malicious. Aztecs, Mayans, Incas, Canaanites, Polynesians, the ancient Chinese, various African tribes, and probably the Celts were all willing to make a trade-off: kill innocent people for the perceived benefit to the community. The logic for abortion, at its core, is pretty much the same. Women have various reasons for wanting to terminate a pregnancy, as do men, but it ultimately snuffs out an innocent life so other people’s lives can proceed unencumbered. Even in the most difficult circumstances, such as incest or rape, the infant’s life is being sacrificed for the benefit of other people. The same principle is at work in this kind of medical research, but with a seductive twist. The purpose of the child’s sacrifice is to benefit other people, but the results are more readily demonstrated. In one of the University of Pittsburgh experiments, tissues were scraped from the livers of infants at 22 weeks of gestation, and injected into liver disease patients. The researchers hope to use similar cell-based treatments to rejuvenate the withered livers of anyone who can afford it. The rhetoric we’ve heard many times this past year, “if we can save just one life,” is at play here in its most twisted form — ignoring the fact that such medical research costs the lives of countless unborn children. Another study, published in Nature, shows pictures of infants’ scalps growing on the backs of pitiful rodents.

I always thought that if you lived through a revolution it would be obvious to everyone. As it turns out, that’s not true. Revolutions can be bloodless, incremental and subtle. And they don’t require a strongman. They just require a sufficient number of well-positioned true believers and cowards, like those sitting in the C-suite of nearly every major institution in American life. That’s one of the lessons I have learned over the past few years as the institutions that have upheld the liberal order — our publishing houses, our universities, our schools, our non-profits, our tech companies — have embraced a Manichean ideology that divides people by identity and punishes anyone that doesn’t adhere to every aspect of that orthodoxy. This is wrong when it happens at a company Apple or Condé Nast. But there are sectors where the stakes of the ideological takeover are higher. Like K-12 education.
Readers of this newsletter know that I’ve been particularly focused on it. In part, this is because the legacy press is ignoring or lying about the story. In part it’s because the stakes feel so high. But if any area is more urgent, it is the world of medicine, where the ability to speak truthfully is quite literally a matter of life and death. Moran: Senate Parliamentarian Delivers a Crippling Blow to Biden’s Agenda
Senate Parliamentarian Elizabeth MacDonough is one of the few individuals standing in the way of the Democrats’ radical agenda and she’s making the most of her opportunity. On Tuesday, McDonough dealt a crippling blow to that agenda by ruling that Democrats could use the reconciliation process only one more time this session. The ruling means that as long as the filibuster is in effect, Republicans can block anything the Democrats introduce. Indeed, historians and parliamentary experts had been in general agreement that the 1974 Budget Act only gave the majority party in the Senate two opportunities to use the reconciliation process per session, so McDonough’s ruling is hardly revolutionary. But Democrats were counting on at least two and possibly three more uses of the reconciliation process before the 2022 elections.
