The alleged “Nullification Powers” of the individual States are likely the only powers capable of saving us in this age of a tyrannical, lawless and unconstitutional Federal Government. The power of the States to nullify unlawful Federal edicts is ostensibly hidden in plain sight within the single sentence that comprises the Tenth Amendment to the U.S. Constitution: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the People.” The Tenth Amendment to the U.S. Constitution serves as a sort of exclamation point for the message conveyed throughout the Constitution: The powers of the Federal Government are intended to be the least of the powers governing our country—and in particular powers that are well-circumscribed, specific, and limited. All remaining power is to be vested in the States and the People. And where there is confusion, the power of the individual States, and the People, supersedes. Lamentably, the Supreme Court has never upheld the ‘nullification interpretation’ of the Tenth Amendment, citing the Constitution’s Supremacy Clause to mean Federal law is superior to State law. And since Federal law—in particular Article III—grants the Supreme Court sole authority to interpret the constitutionality of Federal law, this means there is no role for the States to do so. But logic suggests that the Constitution’s Bill of Rights contains the Tenth Amendment for a reason. Moreover, since the Bill of Rights is comprised of the first Ten Amendments to the Constitution it is only logical to presume that when the Tenth Amendment was written it obviously took into account the language already written and present in the Constitution. Clearly, then, the authors of the Bill of Rights believed the Tenth Amendment provided some sort of useful function to the States—some significant degree of power to the States—that would at minimum justify the ink used to print it. And if this were the case isn’t it prudent to consider that such powers must need be consequential—such as the power to defy a federal law or edict the State thinks unlawful – or even unconstitutional?

When its president, though, wrote to Joe Biden suggesting that parents who complain about Critical Race Theory, masks, and transgenderism are domestic terrorists, it popped up on our radar. And when the DOJ promptly agreed with that suggestion by promising to send FBI agents to become involved with local school boards, people started wondering just who or what the NSBA really is. Here’s how the NSBA describes itself: . . .

Local mother Stacy Langton stood before the Fairfax County School Board in a suburb of the nation’s capital two weeks ago, boldly exposing explicit examples of child porn and pedophilia in library books in area schools, available to children as young as 12 years old. Langton’s witness ended in mayhem because the school board failed to do something very simple: listen to the stakeholders — and taxpayers — who are parents. Board members rudely interrupted Langton during her two minutes of allotted speaking time and called a hasty recess, a board member later incorrectly claiming that he faced two “exorcisms” by parents praying during the meeting. “Shame! Shame! Shame!” shouted parents, horrified at the cowardice of the board members. Now, however, instead of recognizing Langton for the hero that she is for protecting children, U.S. Attorney General Merrick Garland has issued a declaration of war on America’s parents. “I am directing the Federal Bureau of Investigation, working with each United States Attorney, to … [address] threats against school administrators, board members, teachers, and staff,” he wrote in a memo to FBI Director Christopher Wray and the U.S. attorneys generals on Monday night.
Langton, of course, didn’t threaten anyone. But in this war, facts don’t matter. […] It’s now the United States vs. America’s parents.

Joe Biden indicated late Tuesday he was warming to a Democratic proposal to blow up the rules of the Senate to raise or suspend the debt ceiling, amid fears that a breach would send the U.S. government into default and the whole economy into a tailspin. The president told reporters that a filibuster carve out to solve the current stalemate with Republicans over the debt limit before the estimated Oct. 18 deadline was a “real possibility.”

Frazin: White House proposes reversing parts of Trump rewrite of bedrock environmental law implementation
The White House said in a statement that it would propose reversing parts of the Trump administration’s rollback of the implementation of a law called the National Environmental Policy Act (NEPA). NEPA requires the government to consider environmental impacts of major projects, and governs the construction of things like airports, highways, buildings and pipelines. The changes announced Wednesday by the White House Council on Environmental Quality (CEQ) are considered to be “Phase 1” and will restore provisions that had been in place for decades. Specifically, it would seek to ensure that additional environmental implications are considered and give more flexibility to government agencies to consider project alternatives. In the coming months, the administration will work on a second set of “Phase 2” changes. […] One of the most controversial changes to NEPA instituted by the Trump administration is the change in what makes up the impacts that must be considered under the law, getting rid of specifications to consider . . .

“Educated idiots” is how my old man described college-educated people who were completely devoid of common sense and moral intelligence, or what Aristotle called “practical wisdom.” But what made them especially annoying was their arrogance, their assumption that because they were professionally credentialed in one area, they were equally knowledgeable about everything else. […]. . . over the last 150 years, the broadening of formal education to include the masses, the increase and hyper-specialization in university disciplines, and the prestige of the natural sciences from the technologies that improved material existence, have made this bad habit ubiquitous. Worse yet, the aggressive promotion during the last fifty years of “college for everyone”–– which necessarily required lower standards and a decline in foundational skills––multiplied the numbers of people with this affliction, even as the quality of their degrees was degraded. Those trained in the humanities and soft “sciences,” that is, disciplines that lack the rigor and real-world accountability of real sciences, are particularly prone to this intellectual disease. This phenomenon explains why we see so many preposterous, unsubstantiated, politically biased, and just plain whacky ideas like Critical Race Theory or “white fragility” promulgated by self-styled “brights” with such arrogant certainty, and passed off as “science.”

Skurkiss: If America’s going to split apart, here’s what will happen to you
When Abraham Lincoln spoke the prophetic words “a house divided against itself cannot stand” — in a speech before the Illinois Republican state convention in 1858 — he was a relatively unknown politician. He saw the obvious: North and South were hopelessly divided over the issue of slavery — or more fundamentally, states’ rights — and a breakup was all but all but unavoidable. This came to pass in just a few years’ time in the form of the Civil War. Is America nearing a similar point in 2021? Today it is not so much North versus South or free states versus slave states; rather, it is red states versus blue states, the heartland versus the coastal states, elites versus middle class, leftists versus conservatives. No matter how you chose to define the divide, a chasm has grown between two distinct groups living within in the U.S. The room for compromise and accommodation seems to be shrinking by the day. Joe Biden’s candidacy was based on the promise that he would bring us together. Look at what we got instead: more divisiveness, stoked by the Biden administration itself. Left-Wing Billionaire George Soros Bankrolling Group Behind Harassment of Kyrsten Sinema
Activists with Living United for Change in Arizona filmed Sinema while she was teaching at Arizona State University on Saturday after she refused to meet with the organization to discuss her opposition to a $3.5 trillion “Build Back Better” spending bill. Soros’s Open Society Foundation is Living United’s biggest donor. The group gave $1.5 million to Living United in 2019 and $250,000 in 2017, according to the philanthropy’s grants database. Living United reported around $1.7 million in revenue in 2019 and $328,000 in 2017. The Living United activists may have broken Arizona law, which says it is illegal to photograph or videotape another person in a restroom “where the person has a reasonable expectation of privacy” and is relieving themselves or undressing.
