Barkoukis: State Republicans See Third Flip of Year After Win in Texas District
Republicans on Tuesday saw their third flip of a state legislative seat in 2021 special elections after John Lujan pulled off a victory in Texas House District 118, which President Biden won by 14 points in 2020.  The win comes after flips in a Connecticut district by Ryan Fazio in August and one by Jon Dunwell in Iowa—a district that had been blue for the last 46 years.

Fairbanks: MA Teacher Forced to Resign After Attending Jan. 6 Protest Wins School Board Seat
A Massachusetts teacher who was forced to resign after photos of him at the Capitol on January 6 were shared online has won a seat on the district’s school board. The former Braintree High School teacher Matthew Lynch, 35, was visited by the FBI during his campaign. […] “Lynch accused those who shared the picture and FBI information of ‘slandering me as a domestic terrorist.’ He called the group a ‘digital Lynch mob’ who ‘decided they would take justice into their own hands,’” Patch reports. “Lynch said the FBI visits stemmed from tips called in after the FBI phone number was shared in community Facebook groups.” In his resignation letter to the school, Lynch wrote about how his military experience has left him very concerned about the direction of our nation. […]  Lynch told the Patriot Ledger that he is looking forward to “getting decision-making back with parents and away from the state” when it comes to schools.

BeMiller: Republican Mike Carey wins 15th Congressional District race
Republican Mike Carey won the special election for Ohio’s 15th Congressional District on Tuesday, securing GOP control of the seat as Republicans fight to take back Congress next year. Carey led Democratic state Rep. Allison Russo with 58.3% of the roughly 160,000 votes cast, according to unofficial results. He will take office immediately and replaces former Republican Rep. Steve Stivers, who left Congress in May to lead the Ohio Chamber of Commerce. Carey, a coal lobbyist who lives in Columbus, faces a quick turnaround to run for reelection in 2022.

Solomon: Buyer’s Remorse: Americans repudiate leftward drift on cops, schools and economy
Across the country, Democrats also must evaluate their national and local strategies on defunding police and Black Lives Matters, movements begun in the aftermath of the George Floyd tragedy that waned as violent crime spiked in urban areas where police resources were cut.
Minneapolis voters rejected by a 57-43 margin a plan to dismantle the Minneapolis Police Department and replace it with a new public safety agency. The vote was a stinging rebuke for defund-the-police advocates and exposes a generational schism between older black voters and white voters who distrusted the plan and younger minority voters who embraced it as a solution to the Floyd tragedy that rocked the city. Adams, a former police captain with a law-and-order plan to fight violence in the Big Apple, won handily in New York City in a rejection of outgoing Mayor Bill DeBlasio’s anti-police policies. Likewise, the top two finishers in Atlanta’s mayoral race, both of whom head to a runoff, were Democrat candidates with plans to grow the size of that city’s police department after a year of relentless growth in violence.  But in Austin, Texas, an increasingly liberal bastion inside red Texas, voters rejected increasing the funding to that city’s police department by a large margin.

Kopel: Supreme Court To Decide If Dred Scott Should Apply To All Americans On Guns
On Wednesday, the Supreme Court will hear oral argument in New York State Rifle and Pistol Association v. Bruen, to decide whether the Second Amendment right to “bear arms” is a legally enforceable right. The case raises some of the same questions that were at issue at the infamous 1857 Supreme Court case Dred Scott v. Sandford. The Dred Scott majority held that free blacks could never be citizens of the United States, so plaintiff Scott could not bring a case in federal court. In support of the supposed “absurdity” of free blacks having citizenship rights, Chief Justice Taney described a parade of horribles that would ensue. […]  So according to the Supreme Court, the “right to . . . keep and carry arms” is like “the right to . . . full liberty of speech,” the right to interstate travel, and the “the right to . . . hold public meetings on political affairs.” Each is an obvious individual right of American citizenship.

Berrien: Supreme Court Refuses To Hear Appeal From Catholic Hospital Over Transgender Surgery
On Monday, the U.S. Supreme Court rejected an appeal from a Catholic hospital to dismiss a lawsuit that targeted it for not permitting a woman who identifies as a man to have a hysterectomy performed there.  “The justices turned away an appeal by Mercy San Juan Medical Center, a Sacramento-area hospital owned by Dignity Health, and let stand a lower court ruling that revived Evan Minton’s lawsuit accusing it of intentionally discriminating against him in violation of California law because he is transgender,” Reuters reported. Only Justices Clarence Thomas, Samuel Alito and Neil Gorsuch were willing to hear the hospital’s appeal.

Mark Ibrahim, an Army veteran who was fired from the DEA over his participation in the events of January 6, spoke out in Tuesday’s episode of Fox News host Tucker Carlson’s series on the fallout from the riot. Ibrahim made the explosive claim that he was invited to attend Donald Trump‘s ‘Stop The Steal’ rally by an FBI informant he knew from his military service, who subsequently urged him to join the mob breaking into the Capitol, which he refused. Carlson claimed to have confirmed this by speaking to the alleged informant, whom he did not name. His controversial series ‘Patriot Purge’ on the streaming service Fox Nation has drawn strong reactions for depicting the law enforcement response to the riot as a political purge. […]  Emily Grace Rainey was serving as an Army captain assigned to the 4th Psychological Operations Group at Fort Bragg when she led a group of 100 members of Moore County Citizens for Freedom, which describes itself online as a nonpartisan network promoting conservative values, to the Washington rally to “stand against election fraud” and support Trump. Rainey says the group consisted mostly of ‘grandmothers,’ but that she was accused of leading an armed ‘militia’ to the Capitol, which she insists she never entered. The Pentagon launched an investigation into Rainey’s actions and she submitted her resignation in September, saying she was pressured out after her clearance was revoked.

A Google news search for Nathan DeGrave will show nothing more recent than two weeks old. This is peculiar, given that his letter on the conditions at the D.C. Department of Corrections was published October 30 and should be the biggest story in America. DeGrave is a January 6 protester who has spent the last nine months in a special prison block at the D.C. Department of Corrections. He has not had a trial. He has not been convicted of the crimes with which he is charged. He is there for the purpose of keeping the rest of us at home. He is there as a reminder that, while the government may not care about violent crime on our streets, there is no limit to their brutality when their own power is threatened. The January 6 protesters were not, by themselves, a threat to that power. But inasmuch as they represent you and me and hundreds of millions of Americans who love their country, the government has taken it upon themselves utterly to destroy them—their lives, livelihoods, and health—as a warning to the rest of us. Simonson: Dems Propose Massive Tax Cut for Rich in Budget Deal
Congressional Democrats are finalizing a half-trillion-dollar tax cut for the wealthy, a provision larger than any new welfare program in the budget reconciliation. Reinstating the State and Local Tax (SALT) deduction will cost an estimated $500 billion, more than 2.5 times the size of the child tax credit and earned income tax credit combined. The provision allows taxpayers to deduct the amount they pay in state and local income, property tax, and sales tax from their reported federal income. Under the 2017 GOP tax cut, the SALT deduction was capped at $10,000. The Democratic plan would make it unlimited for five years. Nothing else in the $1.75-to-1.85-trillion proposal carries such a large price tag. A new program for universal pre-K and affordable child care costs $400 billion. Investments in affordable housing costs $150 billion, and expansions to Medicare and Medicaid cost $165 billion. The inclusion of the SALT deduction is a win for such Democrats in high-tax states as New Jersey . . .
