The Fifth Circuit Court of Appeals reversed a lower court’s ruling that “sovereign immunity” protects the Food and Drug Administration (FDA) from any wrongdoing or harm in telling the public to stop taking ivermectin, a safe, well-studied, and proven drug for the prevention and treatment of COVID-19.

In their opinion, Judges Clement, Elrod, and Willett state, “FDA argues that the Twitter posts are ‘informational statements’ that cannot qualify as rules because they ‘do not ‘direct’ consumers, or anyone else, to do or refrain from doing anything.’ We are not convinced.” “We are very pleased with this development and extremely proud of our colleagues for taking a stand against a government health agency that is clearly overstepping its authority,” said Pierre Kory, M.D., M.P.A., president and chief medical officer of the FLCCC. “The FDA’s campaign against ivermectin continues to be used as an excuse by hospitals to deny access to a lifesaving treatment and weaponized by medical boards to threaten the licenses of doctors who stray from the mainstream to prescribe a drug that has been proven in controlled trials to safely treat hundreds of thousands of patients around the world.”

Schonfeld: Judge confronts novel issues in whether to move Meadows’s Georgia charges to federal court

A judge is set to rule soon on the first Georgia 2020 election co-defendant’s attempt to move their charges to federal court, a decision that could prove decisive for the future of Fulton County, Ga., District Attorney Fani Willis’s (D) criminal case. Former Trump White House chief of staff Mark Meadows wants U.S. District Judge Steve Jones to allow him to switch courts to attempt to get his charges thrown out on immunity grounds. It would also widen the jury pool to less Democrat-heavy areas and likely prevent a televised trial allowed by state law. If Meadows succeeds, legal experts say it would make it easier for former President Trump, who on Thursday pleaded not guilty to the Georgia charges, to follow in his footsteps. It is an urgent, dangerous, and deadly problem in our country.” Extreme heat, also known as summer, is normal in states like Florida, Texas and Arizona where Mayorkas ominously warned the population was on the verge of death due to global warming. The biggest threat to Texas and Arizona isn’t coming from a summer heat wave, but a mass invasion of illegals flooding across the border. […] The DHS ‘virtual summit’ on ‘extreme heat’ was perfectly timed for the end of summer, and packaged with a “first-of-its-kind resource guide” full of useless suggestions for public officials like appointing a ‘Chief Heat Officer’ to watch the thermometer and sending out ‘Code Red’ alerts warning everyone it’s really hot outside and that they should turn on the air conditioning. […] That is not what cities actually want from DHS. […] The Homeland Security Act does not mention that it’s the role of DHS to police the weather.

So what is DHS currently doing? It’s “addressing climate change” and “uniting for Ukraine”. The last National Terrorism Advisory System Bulletin, much of its reason for existence, was last issued in May 2023. Instead DHS has a blog on “breastfeeding and returning to your workplace” and ‘Risk’ assessments for global warming for areas around the nation.

Ceres team: New study suggests global warming could be mostly an urban problem

A new study published in the scientific peer-reviewed journal, Climate, by 37 researchers from 18 countries suggests that current estimates of global warming are contaminated by urban warming biases. The study also suggests that the solar activity estimates considered in the most recent reports by the UN’s Intergovernmental Panel on Climate Change (IPCC) likely underestimated the role of the Sun in global warming since the 19th century. It is well-known that cities are warmer than the surrounding countryside. While urban areas only account for less than 4% of the global land surface, many of the weather stations used for calculating global temperatures are located in urban areas.

If there’s a terrible dystopian idea out there, it seems Microsoft founder Bill Gates is always sure to fund it. The latest insanity in which he’s investing is a project to chop down and then bury millions of acres’ worth of trees. Supposedly, this will help save the Earth from climate change.

MIT Technology Review reported that Kodama Systems had raised around $6.6 million, a hefty sum, from Breakthrough Energy Ventures, billionaire Bill Gates’s climate fund. Trees will be cut down in California and buried in Nevada for this “stealth effort,” which Kodama characterizes as “biomass burial.” The Epoch Times posted a video clip on August 30 explaining Kodama’s plan to cut down and bury trees on millions of acres and how Gates is involved if you want a less credulous account than what MIT Technology Review provided. Yale researchers and payment company Stripe are also reportedly involved in funding or supporting the plan. The first irony about this plan is that climate alarmists have spent many years hysterically insisting that no brush thinning or logging can occur, to the point where forests turned into tinderboxes just waiting for massive wildfires to happen. Yet now suddenly trees are “fire hazards,” and logging isn’t bad for the environment. It’s the only thing that can save us?

The turbines that onshore wind developments use to generate power can be up to 200 feet in length, and the material that they are made of is rigid, according to Texas Monthly. These attributes make the equipment difficult to remove or recycle after they are decommissioned, a reality which can lead to these turbines piling up in communities like Sweetwater, Texas, and irritating some of the locals who have to live in close proximity to the waste. Discarded turbines now occupy about 30 acres of land in Sweetwater, according to Texas Monthly. Locals worry that there may not be a viable plan for getting rid of the equipment, leaving the piles of material to sit as dens for rattlesnakes and mosquito breeding hotbeds. […] The U.S. may generate nearly 7 million tons of waste related to wind power by 2050, according to a 2017 study published in Waste Management, a scientific journal that focuses on the academic “discussion of information on solid waste generation,” according to its website. After Silicon Valley Bank failed, President Biden told Americans they “can rest assured that our banking system is safe. Your deposits are safe.” Yet, for many, it is increasingly clear that this is not the case. Across the Western world, banks are unsafe for those holding views that diverge from state-approved media narratives. Banks routinely close accounts of depositors with views that diverge from the accepted narrative, often without notice, a practice called “debanking.” Even a cursory review of recent debanking incidents makes it clear that conservatives and conservative groups are disproportionately affected. And the advent of a cashless economy fueled by central bank digital currencies (CBDC) will exacerbate this trend. With CBDCs, governments will be able to directly control access to financial services. Though it has accelerated, debanking is not uniquely American, nor is it new. Across the West, digitized banking has resulted in a top-down politicization of financial services, enabling the debanking of individuals and large enterprises.

Washington bureaucrats are now poised to push abortion ‘vacation’ policy on the entire American workforce, effectively by executive fiat. How can Washington bureaucrats take a law that could prevent abortions and turn it into an instrument to encourage them? When the pro-abortion Biden administration is writing the regulations, that’s how. At least, that’s a possible outcome regarding the Pregnant Workers Fairness Act (PWFA). That law, passed as an amendment to last year’s omnibus spending bill, gave pregnant women common-sense rights in the workplace. Similar to the process outlined in the Americans with Disabilities Act, the PWFA requires most employers to make reasonable accommodations for their workers’ pregnancies, so long as those accommodations do not create an undue burden on the business. The law will give pregnant workers the right to, for instance, take more frequent bathroom breaks or carry water with them at their job site. The measure seems like a common-sense, pro-family measure, one that both sides of the partisan divide can support as a way to make life a little easier for pregnant workers and, in so doing, perhaps discourage some from considering abortion as an option. That is until the Biden administration got involved.

Fordham Institute, Meredith Coffey, Ph.D., and Adam Tyner, Ph.D., analyzed nearly two decades of assessment data from the National Assessment of Educational Progress (NAEP) on eighth-grade reading, math (from 2003 to 2022), and science (from 2009 to 2019). They defined “excellence” as students who earned “advanced” scores on math and readings of the NAEP assessment. They used the mother’s education as a proxy for the student’s socioeconomic status since the NAEP questionnaire collects such data by asking test-takers to select from the following options: “She did not finish high school,” “She graduated from high school,” “She had some education after high school,” “She graduated from college,” or “I don’t know” (the final group was excluded from the analyses). Cole: Experts Are Scared as Child Deaths Spike Sharply

According to Dowd’s findings, death rates among children in the UK are climbing, fast. The yearly excess death data shows the years 2020 and 2021 had negative excess mortality rates, at -9% and -7%, respectively. During those two years, therefore, the death rate among children in that age group was lower than anticipated. However, these child death rates spiked dramatically in 2022 and 2023. This metric spiked to 16% more deaths among children than anticipated in 2022. The figure has continued to soar into 2023, however. So far in 2023, there have been 22% more child deaths than expected. Dowd argues that the only possible explanation for this rise in mortality during that period is the COVID-19 vaccine rollout for this age group.

Sexton: Giant Food makes a last ditch effort to stop retail theft

Back in May I wrote about Giant Food, a grocery chain in the Washington, DC area. My grandparents shopped at the Giant Food in Silver Spring, MD for most of their lives so I’ve been to that location many times. But latetly the chain is struggling with retail theft, or shrink as it’s known in the industry. Ira Kress, the president of Giant Food told the Washington Post, “To say [theft has] risen tenfold in the last five years would not be an understatement.” Saturday the Post published a follow up story about Giant’s last ditch efforts to combat shrink at their last remaining store east of the Anacostia River by removing lots of frequently stolen name brand products from their stores. […] This is a sad state of affairs. No one can afford to be the last store in the neighborhood to lock up certain products because all the thieves quickly learn where to go. But if Giant isn’t able to stop the theft the store will close. It’s the only full-sized grocery store left in Ward 8 which is in the eastern part of the city. That one store currently serves about 80,000 people who live in the ward. If it disappears it’s unlikely anyone else will be eager to open a grocery store in the area.

After backlash from Hindus over a bill that was very clearly targeting them, Sen. Wahab and her political allies claimed that she was facing Islamophobia and death threats from “extremists”. Time Magazine sent a Muslim journalist to interview Wahab about the Islamophobia she was suffering from. And as the anti-Hindu bill moves closer to becoming law, the media has doubled down on this approach along with refusing to notice the obvious.
