In a 14-page opinion and ruling today [SEE pdf HERE] four judges from the DC Circuit Court of Appeals deconstruct the previous ruling from their own court as well as the DC judge beneath them that gave Special Counsel Jack Smith access to President Trump Twitter account data and then enforced a non-disclosure order. There are multiple layers to this story, but the substantive part is the scheme and the construct of how the Lawfare took place. There’s no way this was coincidental; I’ll explain why. First, there are only 7 members on the full DC Circuit Court of Appeals. When the Twitter case to gain access to President Trump communication came to the appellate level, somehow all three of the most left-wing judges were assigned to hear the appeal. An “en banc” review would have included the full 7 members. However, that review was made moot by the release of the information (a result of the appellate decision). The release itself was done with the use of a non-disclosure order, hiding the ruling in secrecy and keeping President Trump from knowing about it. Once the other four members of the DC CCA eventually found out about the case and the ramifications for ‘executive privilege’ their opinion lambasting their own court is released. […] The Circuit Court justices note that Jack Smith could have gone to the National Archives for the information as they held the same set of documents and information. However, Smith didn’t want to go that route because the National Archives would inform President Trump as customary and provide him the ability to assert executive privilege over any of the 32 Direct Messages requested. Jack Smith didn’t want President Trump to know the prosecution was looking through his Twitter metadata and personal communication, so they went to district court under seal to file their search warrants in secrecy; then banning Twitter (the third party) from telling President Trump about it.

Late Monday, the court sided with an 11-state lawsuit against a Department of Energy (DOE) rule repealing a Trump-era rule that exempted faster dishwashers and washing machines from strict water-use standards that would ban many of the products sold in stores today. While the court ruled that the DOE’s repeal-rule is “arbitrary and capricious,” it simply sent it back to the Department, apparently without throwing it out:

First class air passengers are much more damaging to the environment than the average traveler, according to new research. The paper (PDF), published in May, explains that those who enjoy first class service have a carbon footprint that is over nine times larger than the humble passenger crunched up in coach class. First class seats are bigger than the standard berth, meaning less people can get on a plane. This results in more fuel being burnt per person to get the aircraft to its destination. Moreover, passengers flying in luxury are likely to carry more bags, adding more weight to the plane and consuming more fuel.

How safe are you nowadays on commercial airliners? How safe will you be tomorrow? The Food and Drug Administration wants to continue its selective promotion of off-label drug use: good for COVID-19 vaccines, bad for alternatives to those vaccines. It just doesn’t want the public to see its full reasoning for the latter. The FDA and the Department of Health and Human Services filed a renewed motion to dismiss a lawsuit by doctors claiming the agencies have a practice of demonizing ivermectin by conflating its human and animal doses and using “command” language, such as “stop it,” to discourage using the anti-parasite drug against COVID. But it was filed under seal, with the agreement of U.S. District Judge Jeffrey Brown and plaintiffs Drs. Robert Apter, Mary Talley Bowden, and Paul Marik, who claim they suffered wide-ranging injury from the anti-ivermectin campaign. The feds cited “lack of subject-matter jurisdiction” – the doctors lack legal standing – in a Dec. 2 request for an extension of time to submit the dismissal motion. The agencies are starting over after the 5th U.S. Circuit Court of Appeals reinstated the lawsuit last year, finding the doctors plausibly alleged the FDA exceeded its authority through “tweet-sized doses of personalized medical advice.”

On Christmas Day, 1959, a newly rededicated synagogue in Cologne, Germany, was prominently defaced with swastikas. Immediately thereafter, a “swastika epidemic” broke out in over 20 towns and cities across West Germany, targeting other synagogues, Jewish cemeteries, and Jewish-owned shops. “Death to Jews” and “Jews go home” were among the antisemitic slogans that accompanied this sudden outpouring of Nazi sentiment. In no time at all, a wave of similar incidents occurred around the world. By early March 1960, swastikas appeared seemingly everywhere, so much so that within a three-month period, public expressions of anti-Jewish hatred occurred in 34 countries. In the United States alone, 637 incidents of this kind were recorded in 236 cities and small towns, some of them accompanied by death threats and attacks on Jews and Jewish institutions. Many were shocked, for under the sign of the swastika Jews had been murdered by the millions in some of the same countries now witnessing this sudden outpouring of hostility against Jews. Was this renewed display of Jew-hatred a continuation of Hitlerian passions or would it pass? Answers were not easy to come by, but the “swastika epidemic” of 1959-60 petered out after a time, and the antisemitism it represented became relatively quiescent for a while. It has revived in our own day, and energetically so. Swastikas are back, and the hatred they symbolize is more vocal, more visual, and more pervasive than it has been for decades. One sign of the emotional high triggered by this hatred is the reappearance of swastikas. In addition to swastika graffiti and a range of anti-Jewish hate messages appearing in public places in New York city and elsewhere, the Nazi symbol frequently shows up in anti-Israel street protests, sometimes in novel ways. Examples include people in crowds holding up cellphones whose screens show large swastikas. More elaborate are handmade posters featuring a large swastika pointing to the words “Israeli Military = Nazis.” Or signs with blood-stained swastikas intertwined with the Star of David. Or large swastikas supplanting the Star of David in the middle of refashioned Israeli flags. In still another perversion of this same visual ploy, American flags have been redone to show the stars replaced by swastikas and “Free Palestine” inscribed between the stripes.

Greenfield: New York Cuts Money From Schools to Pay for Migrants

Gov. Hochul has unveiled a budget with $2.4 billion allocated for caring for the mass of illegal alien migrant invaders. In other cases, Gazan doctors collaborated with Hamas terrorists to covertly treat kidnapped Israelis and imprison them in hospitals. The no pants events were promoted in the media as a fun and light-hearted way to ride the light rail or subway. “Don’t miss an opportunity to get ‘cheeky’ in Phoenix,” gushed NBC News affiliate 12News. “Under where? Underwear on the Valley Metro Rail on Jan. 14, that is.”

The event is a spin-off of the “No Pants Light Rail Ride” that occurred in the Valley from 2009 to 2020. The No Pants Light Rail Ride was inspired by a similar event staged on a New York City subway by an improv group in 2002 and has since spread across the world. […] Organizers stressed that nudity was not allowed and that public indecency rules still apply. Some individuals appeared to push the limits. The Daily Wire’s Matt Walsh noted on X that some of the riders wore fetish gear in front of children.” This is horrific. Every adult involved should be in jail,” he wrote.
