Sexton: Supreme Court Hears Social Media Censorship Case (The Twitter Files Goes to Court)

Last March, Matt Taibbi testified before congress about the investigation that was widely known as the Twitter Files. Here’s a bit of what he had to say. […] On July 4th last year, a federal judge in Louisiana granted a preliminary injunctions forbidding the government from many interactions with social media companies. The judge wrote that the case appeared to involve a “massive attack against free speech.” […] The White House pushback on the Twitter Files and this case was that the government hadn’t ordered anyone to do anything it had just held collegial meetings with representatives of the social media companies and occasionally sent over lists of problematic accounts. If the companies decided to remove or limit those accounts that was their doing, not the government’s. Nevertheless, the ruling was seen as a major blow to White House efforts to control disinformation. […] The DOJ appealed the case to the Fifth Circuit Court of Appeals the following day. Initially the Appeals Court lifted the injunction preventing the Biden administration from discussing disinformation with the social media companies but in September the Appeals Court agreed with the lower court’s decision: […] Once again, the DOJ appealed the case, this time to the Supreme Court. The September appeal argued that the White House had the right to use the “bully pulpit” both in public and in private. Agents at the Central Intelligence Agency, the Federal Bureau of Investigation, and throughout the intelligence community were distributed a newsletter that celebrated an intelligence official for crossdressing, saying that dressing up in women’s clothes makes him “a better intelligence officer,” according to an internal document obtained by The Daily Wire. The Office Director of National Intelligence sent its internal newsletter, called “The Dive” and obtained by The Daily Wire through a Freedom of Information Act request, to personnel across the entire Intelligence Community. Featured in the newsletter was an article by an anonymous official claiming that crossdressing makes him a better intelligence officer. “I am an intelligence officer, and I am a man who likes to wear women’s clothes sometimes,” the article, titled “My Gender Identity and Expression Make Me a Better Intelligence Officer,” states in its opening line. The author goes on to argue that his decision to crossdress “merits attention given the climate of discussion around the topic and where it sits in the larger conversation about gender identity and expression and professional appearance.”

On 6 March, a Houthi missile attack on a merchant ship off the coast of Yemen, killed three crewmen and forced evacuation of the burning ship. The fatalities were the first in the Houthis’ ongoing attack on shipping in the international waters of the Red Sea. Houthi disruption to maritime traffic in the region has continued nearly unabated for months, despite multiple rounds of U.S. and allied strikes to degrade Houthi capacity. The result should be a shift in policy from the Biden administration to one of blockade that cuts off the Houthis from their Iranian masters, and thereby erodes the threat. This would impose costs on both Iran and its proxy neither of which will stand down once the war in Gaza ends. But successful blockades require naval combatants: the U.S. continues to experience its decades long decline in naval capacity. U.S. Supreme Court Justice Samuel Alito commented on the exclusion of two Christians from serving on a jury in a case involving a lesbian. Alito’s statement described this decision as a worrisome sign that Americans publicly professing biblical perspectives on social issues are increasingly viewed as intolerant and potentially face exclusion not only from serving on juries, but from protection of the free exercise of religion as guaranteed by the First Amendment. This observation came after the state of Missouri requested the Supreme Court to examine the verdict. Here’s some background on this potentially precedent-setting case. […] Missouri’s appeal contested the appellate court’s support for the exclusion based on the jurors’ religious convictions, which the appellate court justified by agreeing with the trial court that such jurors could not impartially approach the case due to their views on the plaintiff’s sexual orientation.

Prohibiting these two jurors from hearing a case involving a homosexual defendant could potentially result in the permanent taint of Christians as “homophobic” or “transphobic” and their being automatically disqualified from serving on juries, and perhaps even serving as judges. Such a distinction would render Christianity a “scarlet letter,” a signal to everyone that such a person must be marginalized and precluded from participating in any judicial or political processes, leaving such arenas available only to those rejecting traditional norms.

A new study revealed that people with so-called “woke” ideologies tended to be more unhappy, anxious, and depressed compared to others. The study – published in the Scandinavian Journal of Psychology last week – found that individuals with attitudes geared toward critical social justice were less satisfied with their lives. The first study examined 848 adult participants – 382 staff members and 266 students of the University of Turku in southwestern Finland as well as 64 staff and students from other Finnish universities, two from foreign universities, and 134 not associated with a university. A second study included 5,030 Finnish citizens aged 15–84. The true crime genre is not big enough for what Communists and socialists did in Russia in the 20th century. It demands a new genre — perhaps call it true horror. Bill Whittle’s newest season of “What We Saw” on Daily Wire Plus dips its toe in the oceans of blood Russia’s Communist revolution released. It’s grisly and difficult to take in. Whittle attempts to quantify the myriad forms of mass killings by comparing their death tolls to the erasure of several U.S. cities, yet still the numbers are numbing. What’s not numbing is the question he includes in the season’s trailer comparing the Nazi Holocaust with the Soviet mass murder of an estimated 20 million: “Why are we encouraged to never forget one, and then intentionally taught to forget the other?” As Whittle points out in episode one, all educated people know immediately what images like these depict: […] Here are four other things one can learn from studying Soviet history, as horrifying as that exercise can be. 1. Misery Is Normal in Human History: It’s shocking but true that the Soviet empire lasted a long time even as it engaged in mass murder and slavery. Its collapse in the 1980s and 1990s was a shock to most observers. That means this evil empire lasted something like 70 years — in fact, in some sense persists today, as Russia is not a free or happy country now, either. This is normal in human history. It’s hard to believe that when you’re an American and all you’ve ever known is clean and hot water coming out of the tap at a turn. But it’s also important to keep in mind. For one thing, it produces appropriate gratitude. For another, it should discipline hasty desires to “tear it all down,” and cultivate contempt for people who use the same lying words and policies as Communists. 2. Neither Amundsen nor Nansen was a Muslim (Amundsen was a devout Christian who, during his perilous polar expeditions, felt he was entirely in God’s hands; Nansen was an atheist), but no doubt the names of these streets will, in the fullness of time, be changed to honor Muslims who have played key roles in Norway’s Islamization.
