Benjamin Aguiñaga, the solicitor general of Louisiana, a rather revealing question about the issue. “So, my biggest concern is that your view has the First Amendment hamstringing the government in significant ways in the most important time periods,” Jackson said. The Supreme Court justice presented an extremely unlikely hypothetical that most American young people would find very insulting. She presented a scenario in which young people took cellphone video of their peers jumping out of windows, and that trend went viral on social media (preposterous), Big Tech companies failed to take action on their own (very unlikely), and the government wanted to stop it. She asked Aguiñaga, […] The amendment states: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances. The amendment does not include a “crisis-exemption clause” allowing the government to trample on free speech if the president declares a national emergency.

Legal challenges to the law are ongoing at a federal appeals court, but the decision hands a significant – yet temporary – win to Texas, which has been battling the Biden administration over immigration policy. […] Senate Bill 4, signed into law by Republican Gov. Greg Abbott in December, makes entering Texas illegally a state crime and allows state judges to order immigrants to be deported. Immigration enforcement, generally, is a function of the federal government. […] The Biden administration, two immigration advocacy groups and El Paso County are challenging the law.

Schonfeld: Supreme Court unanimously rules against government in No Fly List case

The Supreme Court unanimously ruled Tuesday that a man’s challenge to his former placement on the No Fly List can move forward, finding the government failed to show his lawsuit is moot. Yonas Fikre, a U.S. citizen who previously resided in Sudan, claimed his placement on the list was unlawful and sued the FBI. The government later removed him from the list and signaled it was unlikely he would be readded. It then contended Fikre’s lawsuit was moot as a result and should be tossed. The government warned that not declaring lawsuits like Fikre’s moot at the onset could require the government to disclose classified information. The Supreme Court rejected that assertion, enabling Fikre’s case to move ahead.

Gerstein & Frazier: New Texas law allowing police to arrest migrants back on hold

The Supreme Court on Tuesday gave Texas the go-ahead to enforce a new state law authorizing police to arrest and detain people for illegally crossing the border from Mexico, but hours later a federal appeals court reinstated an injunction blocking the law from being implemented.

Law schools—institutions where our Constitution should perhaps be the most revered—have also been unmasked as centers of censorship and indoctrination, leaving the future arbiters of our laws unable to think critically and objectively. When law students undergo ideological reeducation, principles of American jurisprudence are undermined, leading to a workforce that prioritizes woke activism over legal integrity and feelings over facts. In like fashion, when medical students are indoctrinated with DEI—instead of focusing on unarguable biology, essential surgical practice, and clinical care—lives can be destroyed in a much more literal sense.

Consequently: More than 10 million nonblack Americans with chronic kidney disease may have seen their treatments or transplants delayed because of policy changes enacted after 2020. Some of those patients now face greater risk of death because national transplant organizations have embraced racial activism. Patients of all races deserve a formula that accurately estimates their individual kidney function, not one that favors one racial group at the expense of others.

Hoffman: Washington Supreme Court rules prospective lawyers no longer have to pass ‘racist’ bar exam, claims it ‘blocks marginalized groups’ from practicing law

On Monday, the left-leaning Washington SupremeCourt filed a pair of orders approving “alternative pathways” for people to become lawyers, nixing the requirement to pass the universal bar exam. The court claimed the test “blocks marginalized groups from entering the practice of law” and that bar has “racism and classism written into the test itself.” By doing so, the Evergreen State joined Oregon, the only other state to officially approve alternatives to the bar exam. The Bar Licensure Task Force, chaired by Washington Supreme Court Justice Raquel Montoya-Lewis and Seattle University Law School Dean Anthony Varona, studied options to the traditional bar exam following a year of pandemic-related bar exam modifications. The Task Force concluded in their analysis that the traditional bar exam “disproportionately and unnecessarily blocks marginalized groups from entering the practice of law, and the traditional bar exam is at best minimally effective for ensuring competent lawyers.”
