Less than a handful of years after their hard-won elevation to the Supreme Court, Justices Brett Kavanaugh and Amy Coney Barrett are sending a chill down the spines of conservatives with a string of bad signals from their seats on the court. In July, Kavanaugh and Barrett joined the court’s leftist majority in declining to hear Arlene’s Flowers v. Washington, a critical religious liberty case. They again sided with the court’s left in a similar decision to turn away a religious exemption challenge to Maine’s vaccine mandate — which Justices Neil Gorsuch, Samuel Alito, and Clarence Thomas took pains to note was staggering in its hypocrisy. “A State may not assume ‘the best of individuals engaged in their secular lives while assuming ‘the worst’ about the habits of religious persons,” the trio wrote. Just this week, Barrett and Kavanaugh embraced a theory of judicial supremacy out of step with a more conservative tradition when they both appeared openly skeptical of the construction of the Texas abortion law, which bans the practice after six weeks of pregnancy. All of this should make the guts of conservatives churn in the leadup to next month’s oral arguments in Dobbs v. Jackson Women’s Health, the biggest abortion case the court has heard in decades. Judicial Watch announced today that it filed a response in opposition to the Department of Justice’s effort to block Judicial Watch’s Freedom of Information Act (FOIA) lawsuit asking for records of communication between the Federal Bureau of Investigation (FBI) and several financial institutions about the reported transfer of financial transaction records of people in DC, Maryland and Virginia on January 5 and January 6, 2021. The court filing comes in a Judicial Watch lawsuit against the FBI (Judicial Watch v. U.S. Department of Justice (No. 1:21-cv-01216)) for: All records of communication between the FBI and any financial institution, including but not limited to Bank of America, Citibank, Chase Manhattan Bank, Discover, and/or American Express, in which the FBI sought transaction data for those financial institutions’ debit and credit card account holders who made purchases in Washington, DC, Maryland and/or Virginia on January 5, 2021 and/or January 6, 2021. […]  “This Judicial Watch lawsuit shows how the FBI is corruptly trying to hide that it used the January 6 incident as an excuse to conduct unlawful surveillance of the American people’s bank transactions,” said Judicial Watch President Tom Fitton.

Sundance: John Durham Needs to Look Toward Mary McCord
When the FISA application was finally submitted (approved by Sally Yates and James Comey), it was Mary McCord who did the actual process of filing the application and gaining the Title-1 surveillance warrant. A few months later, February 2017, with Donald Trump now in office as President, it was Mary McCord who went with Deputy AG Sally Yates to the White House to confront White House legal counsel Don McGahn over the Michael Flynn interview with FBI agents.  The surveillance of Flynn’s calls was presumably done under the auspices and legal authority of the FISA application Mary McCord previously was in charge of submitting.

The result of New Jersey’s election for governor will be “legal and fair” no matter the outcome, Republican candidate Jack Ciattarelli said Thursday in his first comments since The Associated Press declared incumbent Democrat Phil Murphy the election’s winner. Ciattarelli has not conceded the election.
“No one should be declaring victory or conceding the election until every legal vote is counted,” Ciattarelli said in the 2-minute video clip posted on Twitter.

Watson: Italian Institute of Health Drastically Reduces Its Official COVID Death Toll Number
The Italian Higher Institute of Health has drastically reduced the country’s official COVID death toll number by over 97 per cent after changing the definition of a fatality to someone who died from COVID rather than with COVID. Italian newspaper Il Tempo reports that the Institute has revised downward the number of people who have died from COVID rather than with COVID from 130,000 to under 4,000. “Yes, you read that right. Turns out 97.1% of deaths hitherto attributed to Covid were not due directly to Covid,” writes Toby Young. […] “All the other Italians who lost their lives had from between one and five pre-existing diseases. Of those aged over 67 who died, 7% had more than three co-morbidities, and 18% at least two,” writes Young.

Scouting’s latest required merit badge is chock-full of critical race theory concepts that will push the BSA further to the left. […]  Not only did the Boy Scouts end their identity as an exclusively male institution when they opened the organization to girls in 2019, they’re also the latest to cave to the nationwide push for critical race theory, or as they and others euphemistically call it, “Diversity, Equity, and Inclusion.”  At the very beginning of this month, the national organization announced a new merit badge entitled “Citizenship in Society,” that will become a required merit badge for those pursuing the rank of Eagle Scout in July 2022. Citizenship in The World, Citizenship in The Nation, and Citizenship in The Community are already required merit badges, each of which I quite enjoyed. So what’s Citizenship in Society?

Kohlmayer: Why Do They Want to Vaccinate Children?
“FDA advisory panel OKs Pfizer vaccine for children 5 to 11,” announced a recent NBC News headline. How could a panel that is supposedly composed of rational clear-headed scientists make such an inexplicable recommendation? Consider the following facts. According to a presentation by Fiona Havers, who works at the Centers for Disease Control and Prevention (CDC) and who is a member of the agency’s COVID-19 Response Team, “[D]uring the 12-month period October 2, 2020 through October 3, 2021, there were 66 COVID-19 associated deaths in children 5-11.” Yes, you read it right. In the last twelve months there were only 66 Covid-related deaths in the 5 to 11 demographic in the whole of the United States of America. To give you a sense of perspective, children in that age bracket are three hundred percent more likely to be murdered (207 deaths) and thirty percent more likely to die of flu and pneumonia (84 deaths) than they are to die of Covid. To give another point of comparison, according to the CDC in 2019, “608 child passengers age 12 and younger died in motor vehicle crashes.” Please contemplate this point well. Children under 12 years of age are nearly 1000 percent more likely to be killed in a vehicular mishap than to die of Covid-19. One more piece of reference data.

Kirsch: Here’s the real reason Comirnaty is not available
The reason Comirnaty isn’t available is because those shots would expose the company to liability since the fully-licensed product doesn’t have the liability waiver of the EUA product. But once the Pfizer vaccine is fully approved in kids, then Pfizer gets liability waiver on all age groups due to a “feature” in federal law for child vaccines (NCVIA). At that time, they are done. They can market the COVID vaccine products under full approval for all age groups and face no liability when it kills or disables you. This is why they are focused on the kids. This is why there is a reformulation at a 1/3 dose and they changed the buffer and the storage conditions (low temperatures not required). All of these will weaken the protection, but result in a safer vaccine (since it is ineffective). But for the clinical trials on the 5-11 year olds, they did not use the formulation they approved in the meeting. This is known as bait and switch. So they used

[Federal Register Notice HERE] […] The OSHA Rule is being authorized by the Dept of Labor under an Emergency Temporary Standard (ETS).  The ETS will go into effect on December 5, 2021, with the final vaccinations and testing in place by January 4, 2022 (sixty days after registration).  There is NO END DATE to the rule.  I repeat, despite the rule being filed under an emergency “temporary” standard, there is no end date for the rule to expire or be reauthorized.

Fineout: ‘We have had enough’: DeSantis will sue Biden over workplace vaccine mandates

Gov. Ron DeSantis on Thursday vowed to deliver a legal attack against new workplace vaccine mandates from the Biden administration that are scheduled to kick in right after the end of the holiday season.
The GOP governor said Florida will join Alabama, Georgia and private employers on Friday in a preemptive legal challenge against a new vaccination-or-test requirement for businesses with more than 100 workers. The state will also quickly file a separate legal challenge against a vaccine mandate for health care workers at facilities participating in Medicare and Medicaid. “I just think people are so sick of constantly being bossed around, restricted, mandated, all these different things,” said DeSantis at an afternoon press conference held at the Capitol. “We have had enough of it and we want people to be able to make their own decisions.”

The Biden administration’s rule mandating vaccinations and weekly COVID testing on businesses with more than 100 employees is unwise, unlawful, and destructive to American communities. The regulation, promulgated by the Occupational Safety and Health Administration (OSHA), has already generated a wave of private vaccine mandates by private employers. The regulation bypassed the traditional notice-and-comment process by issuing an “emergency temporary standard” for a medical procedure that is neither an emergency or temporary.  The federal government does not have the constitutional or legal authority to mandate that private businesses require their employees to inject medicine into their bodies as a condition of employment. But this is not merely an issue of legality. The entire rationale for the Biden vaccine mandate is fatally flawed as a matter of both public health and economic policy.

Morgan: Video: Iranian gunboats point machine guns, swarm US warship
Last week, Iran’s Islamic Revolutionary Guard Corps (IRGC) deployed gunboats in the Sea of Oman and swarmed around the U.S. Arleigh Burke-class guided-missile destroyer USS The Sullivans (DDG 68). Footage of the encounter was released by Iranian media sources. The footage showed the IRGC gunboats swarming around an oil tanker and pointing machine guns at the nearby U.S. warship. Iranian media outlets claimed the IRGC forces were stopping the U.S. from committing an act of “piracy” against an Iranian oil tanker, but that claim has been refuted by at least one U.S. official. The oil tanker in the video also appears to be a Vietnamese-flagged vessel called Sothys.

A government that is now openly of, by, and for itself. A government that is rapidly becoming as opaque, dishonest and abusive as those it used to challenge and even fight.
