BKROP: Bump Stock Ban Headed to the Supreme Court after Appeals Court Deadlocks
You may remember in late March of 2021, the 6th Circuit Court of Appeals ruled that bump stocks were not, in fact, machine guns. The ruling itself was based on the ATF’s bump stock regulation not being entitled to “Chevron Deference,”; a legal doctrine that holds that a court may not substitute its own opinion in the place of reasonable interpretation made by an administrative agency. Once this was decided, Gun Owners of America made the case that the bump stock does not meet the legal definition of a “machine gun.” The 6th Circuit then ruled in favor of Gun Owners of America and said that bump stocks are not, in fact, machine guns. Well, it looks like after an En Blanc session (a session where the entire court reviews and votes instead of a single judge or smaller panel), the 6th Circuit has held an 8-8 tie vote leaving the bump stock ban in place. This ruling is a double-edged sword for gun owners. […] It’s very clear from this quote that David Chipman and his friends in the gun-control lobby have an obvious objective. The bump-stock ban is their legal path to this goal of complete regulation of all semiautomatic firearms. But don’t despair! The tie vote from the 6th Circuit’s En Blanc session allows for a power move from Gun Owners of America. They can now appeal their case to the Supreme Court. […] This case may likely get its day in the Supreme Court, and hopefully, the Justices will see the clear evidence that a “single function of the trigger” means semiautomatic. So today, the bump-stock ban holds; we’ll see what happens when the Supreme Court hears the arguments.

Khan: House passes annual defense policy bill with historic military justice reforms
Late Tuesday night, the House approved a massive must-pass $770 billion defense policy bill that authorizes funding levels and provides authorities for the U.S. military. The final vote was 363-70. […] It also includes historic reforms to how the military investigates and prosecutes sexual assault and harassment cases under the Uniform Code of Military Justice. The bill removes the commander of a military command from “decisions related to the prosecution of covered crimes,” including sexual assault. It also makes sexual harassment a crime under the Uniform Code of Military Justice. […] The measure now heads to the Senate, where it’s expected to pass in the coming days. After it passes in the Senate, the bill will head to the president’s desk to be signed into law.

Foran, Raju, Barrett, & Grayer: House passes new debt ceiling plan after McConnell cuts deal with Democrats
Senate Majority Leader Chuck Schumer and Senate Minority Leader Mitch McConnell have reached an agreement to create a one-time process that would let Democrats raise the debt ceiling on their votes alone, a deal that underscores the lengths the GOP leader will go to avoid a damaging default without Republican support to increase the national borrowing limit. The House took the first step to implement the plan on Tuesday by voting to pass new legislation that will set up the debt limit process. The final vote was 222-212. GOP Rep. Adam Kinzinger of Illinois was the only Republican to join Democrats in voting for the bill. The measure will now need to be taken up by the Senate. The new legislation, if advanced with 60 votes in the Senate, would create a temporary fast-track process to allow Senate Democrats to act on their own to increase the debt limit with 51 votes. The legislation outlines that Congress would have to specify the exact dollar amount of a new national debt limit — likely north of $30 trillion. The fast-track process would expire after January 15.

After months of describing inflation as a “transitory,” Washington has at last admitted what every American has known for some time: inflation is severe and shows no sign of abating. Administration officials refuse to admit error—not unusual in Washington—but they have at least acknowledged the inflationary reality and have walked back earlier comments. Because inflation has more fundamental roots than Washington has yet admitted, it is comforting that monetary policy has at last begun—though only just begun—to deal with the threat. Overwhelming evidence has forced the change in Washington’s tune. At the close of 2020, the Federal Reserve (Fed) confidently forecast low inflation for 2021. Using its preferred indicator, the consumer price index deflator (CPI), it announced its expectation of 1.8 percent inflation for this year. Last spring, the Biden administration also forecast low inflation. Its budget put 2021 CPI inflation at 2.1 percent. By October, the CPI was up at a 7.0 percent annual rate for the year so far, more than three times the budget forecast. The consumer price deflator had risen at a 5.1 percent annual rate, more than twice the Fed’s original forecast. It has become impossible to dismiss reality.
So far, administration spokespeople—Fed Chairman Jerome Powell and Treasury Secretary Janet Yellen—have blamed inflation entirely on supply chain problems. Some official rhetoric unsurprisingly includes the usual accusations of price gouging by evil businesspeople, but that is mostly a way of deflecting blame.

Heine: Report: At Least 2 Students at Barack Obama Global Prep Academy in LA Given COVID Jabs Without Their Parents’ Consent
t least two parents have accused a prep school in South Los Angeles of vaccinating their children without their permission after bribing them with pizza, according to NBC Los Angeles. One distressed mother claimed that her 13-year-old son was told not to tell his parents after he was given a Pfizer COVID-19 injection at Barack Obama Global Prep Academy. Maribel Duarte told NBC LA on Monday that her son recently came home from school with a vaccine card after he had accepted the jab. The boy told his mom that he agreed to get the shot after he was offered pizza. Duarte said that the woman who administered the shot and signed the form told her son not to tell his parents because she didn’t want to get in trouble.

Last week, fifth-grade teacher Amy Parker took the pages of the education site Chalkbeat to celebrate New York City’s initiative to promote “culturally responsive education” in its public schools. Parker introduces her essay by lamenting that “School taught me to hide who I was and what I valued” because it didn’t assign books with characters who had gay parents. But, at the same time, Parker also complains that she “was overly represented in the books [she] read and the classes [she] took.” To make up for this injustice, Parker has now committed herself to providing a “culturally responsive and sustaining education” or “CRSE.” This means that she will pick texts on the basis of “representation” and “diversity” and emphasize racial and sexual identity in all her lessons. Instead of learning about the world and how to contribute to it, her students will now learn about themselves and how to become “agents of change.”

The FOIA requested by mother Michelle Mege asked for “all communications, including press releases, statements, emails, or other correspondence in any format within the LCPS possession” that use the words “sexual assault” or “rape” between May 1 and Oct. 18, 2021. The FOIA request was made in response to two sexual assaults that took place in Loudoun County high schools that parents allege the district tried to cover up.
