With the widespread public furor about whether the Supreme Court will overturn its more-than-landmark 1973 abortion decision in Roe v. Wade, it is necessary to recognize that the Supreme Court’s abortion decisions, in their content and in their judicial methods, are without precedent in American jurisprudential, political, social, cultural, and moral history. For last 48 years—that is, 20 percent of our history—no other issue, public or private, has divided and polarized the country and the Court as its decision in Roe v. Wade. […]  There are at least eight reasons to overturn Roe v. Wade. First, there is the sharpest dichotomy, both in the facts and in the law, between what the Supreme Court thinks abortion is and what the state governments think. There is no comparable example in American jurisprudence. In Roe, Justice Harry Blackmun wrote for the seven justices in the majority, five of whom had been appointed by Presidents Eisenhower and Nixon, that he did not know when human life begins. (He also did not know where in the Constitution the abortion right lay; see below). After purporting to survey legal and medical history back to the ancient Greeks and then forward to the present, he concluded that it was not necessary to resolve that “difficult question.” Later in the opinion, he spoke of an invention of his, the “potentiality of human life.” In the sharpest possible contrast, every state attempt since Roe to limit abortion has been based on the knowledge and assumption that the beginning of life was and is known. The results from the poll show despite about a 50/50 split in response to the question about have you heard of the SCOTUS decision to overturn Roe v Wade, there was almost no statistical change in voter opinion from prior polling. More depressingly for the leftists in media, when it comes to enthusiasm about voting in the mid-terms because of this issue, the enthusiastic crowd is the pro-life happy people. Arama: Bill Maher Blows up Some of the Dem Lies About the SCOTUS Draft Opinion

Bill Maher took on abortion during the panel discussion on his “Real Time” show on Friday night, and, while he is pro-choice, he blew up a lot of the narrative being pushed by the left in the wake of the leak of the SCOTUS draft opinion — that somehow the opinion would make abortion go away and that the decision, if it held, could lead to infringements on rights such as interracial marriage. Joe Biden even lied and claimed that the draft opinion could lead to LGBTQ kids being segregated from other kids in the classroom. Maher brought a little sanity back into the discussion, noting that in some other places in Europe that things were more restrictive when it comes to abortion.

But Roe isn’t the only terrible ruling the Court has delivered. There are many more, and they are integral to sustaining the current rotten regime. If Roe is on its way out, here are seven more rulings that President Trump’s Supreme Court should jettison next. Regents of the University of California v. Bakke

The first glaring constitutional error that the Court has a chance to fix is this case from 1978. The 14th Amendment to the Constitution explicitly bars any state from denying a resident the “equal protection of the laws,” while Title VI of the 1964 Civil Rights Act explicitly prohibits racial discrimination for programs and entities receiving federal funds (which includes almost all schools in the country). So, when the University of California rejected former Marine Allan Bakke’s application to medical school, while admitting far-less-qualified minorities under a racial quota system, he sued. Inexcusably, the Court ignored both the 14th Amendment and the text of the Civil Rights Act. While the Court struck down . . . […]  United Steelworkers v. Weber  What Bakke did for universities, Weber did for the private sector. Title VII of the 1964 Civil Rights Act very explicitly bans discrimination based on race or sex at any employer or labor union with more than fifteen employees. Laboratory assistant Brian Weber sued when he was denied admission to a training program that gave equal slots to whites and blacks, despite whites being far more numerous at the company. Lower courts correctly ruled that this racial discrimination was illegal, but the Supreme Court reversed, and preposterously found that, when the Civil Rights Act banned racial discrimination, it actually allowed it. The Court justified this naked contradiction on the grounds that . . .  […]  Griggs vs. Duke Power Company This decision may be the single most important precedent that must be overturned in America. Everything tyrannical about modern wokeness flows from this 1971 ruling and the calamitous legal doctrine it created: Disparate impact. Prior to Griggs, legislation barring racial and other types of discrimination was presumed to cover deliberate discrimination. If a company refused to hire black applicants, that was racial discrimination, but if it simply required a high school diploma, or a college degree, or passing a job skills test, that was not. Griggs threw all that out the window. Duke Power Company . . . Kelo vs. City of New London . . . Wickard v. Filburn. . .  United States v. Wong Kim Ark . . . Green v. Kelly: Judge Amit Mehta’s Kangaroo Court

Judge Amit Mehta sounded perturbed, to say the least.

The D.C. District Court judge handling numerous January 6 legal matters, including the Justice Department’s high-profile prosecution of the Oath Keepers, flatly dismissed concerns by defense attorneys that the first trial in the case will coincide with public hearings held by the January 6 Select Committee later this year. “Even if Congress is on the steps of the courthouse reading the [final] report, I am not moving the September trial,” Mehta warned during a status hearing last week for nine Oath Keepers accused of seditious conspiracy among other charges. Mehta’s outburst was telling. In any other jurisdiction in the country, a political stunt by a handful of partisan lawmakers would be widely criticized as an unfair hurdle for defendants facing trial on the same issue at the same time—especially for an exceedingly rare crime, akin to treason, for which the government is seeking life in prison. Further, any frustration would be directed at the politicians interfering in such a serious prosecution, not at defense attorneys protecting the best interest of their clients.

Waller: The Biden Administration’s ‘Disinformation’ Board Is A Tool Straight From Soviet Russia’s KGB

KGB term of tradecraft is now part of U.S. Department of Homeland Security governance. The new Biden administration “Disinformation Governance Board,” Homeland Security Secretary Alejandro Mayorkas told CNN, is a “small working group” to “address threats, the connectivity between threats and acts of violence” without “infringing on free speech” and while “protecting civil rights and civil liberties, the right to privacy.” The board has no “operational authority” of its own, Mayorkas said. Mayorkas denied that the board will cause American citizens to be monitored, saying, “we, the Department of Homeland Security, don’t monitor American citizens.” That might be true. But Mayorkas went on to say the Disinformation Governance Board is mandated to provide “best practices and communicate those best practices to the operators” in agencies that do have “operational authority.” Never before has “disinformation governance” been part of the official U.S. government terminology for defending the internal security of the country.

The FDA’s vaccines chief said the agency wouldn’t reject a COVID-19 vaccine for children under 5 “solely” because its efficacy against symptomatic infection was lower than 50%, according to the chair of the House Select Subcommittee on the Coronavirus Crisis. Fox 5 DC: Nearly 50 Virginia schools holding walkouts in support of abortion access

More than 44 Virginia schools and James Madison University will be participating in a Statewide Student Day of Action for Abortion Access on Monday, holding walkouts in support of federal and state measures that will codify Roe v. Wade, including the certification of the Equal Rights Amendment in the Constitution. There is an expected participation of at least 1,000 students with more students participating by wearing green. Some schools have also chosen to continue advocacy throughout the week and hold demonstrations on Monday and Thursday.

Murawski: Medicine’s Tricky Operation: Grafting ‘Systemic Racism’ Onto Hard Science

A few years ago, concepts such as “white supremacy,” “systemic racism,” and “structural intersectionality” were not the standard fare of prestigious medical journals. But a February special issue of Health Affairs, the Washington, D.C.-based peer-reviewed journal, analyzes racial health disparities not through biology, behavior, or culture, but through the lens of  “whiteness,” along with concepts such as power, systems of oppression, state-sanctioned violence, and critical race praxis—a sampling of terms that appear in the issue. The Health Affairs special issue reflects the effort of “antiracist” scholars to transform concepts still considered speculative and controversial—and some say unprovable—into scientific fact. It  is being advanced by other high-profile publications as well, including the New England Journal of Medicine, the Journal of the American Medical Association, and Scientific American, which last year published articles entitled “Modern Mathematics Confronts Its White, Patriarchal Past” and “Denial of Evolution Is a Form of White Supremacy.” But this scientific aspiration faces major challenges. Science demands verification, testability, and replicability, whereas race is a social construct that can be difficult to separate from factors like class or culture, and explaining the data often remains dependent on academic theories about systemic racism. The articles in Health Affairs indicate that elevating the concept of systemic racism from moral certitude to scientific fact will require developing new tools and methods.

Republicans, whose backing would be crucial to pushing legislation through the evenly divided Senate, have opposed adding that money to the Ukraine aid. “We cannot afford delay in this vital war effort,” Biden said in a written statement. “Hence, I am prepared to accept that these two measures move separately, so that the Ukrainian aid bill can get to my desk right away.”

The proposed rules would cut federal funding to for-profit charter schools across the board and require new charter schools to prove their necessity by demonstrating “over-enrollment” in nearby public schools. Turley: From Court Packing to Leaking to Doxing: White House Yields to a National Rage Addiction

Nearly 70 years ago, a little-known lawyer named Joseph Welch famously confronted Sen. Joseph McCarthy (D-Wis.) in defense of a young man hounded over alleged un-American views. Welch told McCarthy that “I think I have never really gauged … your recklessness” before asking: “Have you no sense of decency, sir? At long last, have you left no sense of decency?” It was a defining moment in American politics as Welch called out a politician who had abandoned any semblance of principle in the pursuit of political advantage. This week, the same scene played out in the White House with one striking difference: This was no Joseph Welch to be found. After someone in the Supreme Court leaked a draft opinion in the case of Dobbs v. Jackson Women’s Health Organization, a virtual flash-mob formed around the court and its members demanding retributive justice.  Hogan: The Five Worst Prosecutors in America

In 1940, Attorney General Robert Jackson proclaimed, “While the prosecutor at his best is one of the most beneficent forces in our society, when he acts from malice or other base motives, he is one of the worst.” There are more than just five bad prosecutors currently in office in the United States. But the following five prosecutors have earned notoriety as the worst in America based on vital criteria—public safety, fidelity to the rule of law, personal integrity, leadership, responsible innovations, community relations, office morale, and teamwork with other players in the criminal-justice system. (The list extends beyond just five individuals because some jurisdictions have suffered under the policies of multiple prosecutors.) Marilyn Mosby, Baltimore: Elected in 2014 as Baltimore state’s attorney, Mosby was one of the first prosecutors to campaign on a platform of de-prosecution, decarceration, and denouncing the police—indeed, the entire criminal-justice system—as racist. Once in office, she delivered on her promises. The results for Baltimore have been devastating. Homicides in the city shot up to 342 in her first year in office—a 38 percent increase—and have not dropped below 300 during any year of her tenure. Mosby has attacked the police relentlessly, including her attempt to prosecute six police officers in the death of Freddie Gray, which resulted in no convictions and an ethics complaint against her. She refuses to prosecute entire categories of crimes, much to the dismay of Baltimore businesses. Mosby seems to have no substantive plans for the office, instead spending her time skipping work and traveling around the country, according to an inspector general’s report. Not surprisingly, Baltimore’s population has declined by 35,000 between 2010 and 2020, as residents continue to flee the violence-plagued city.

The Satanic Temple of the United States (TST) plans to file legal challenges against any states that restrict or ban abortions, claiming that such procedures constitute religious rituals for its adherents. […]  To this end, the Satanists plan to file their lawsuits under the federal Religious Freedom Restoration Act (RFRA), a 1993 law that made it illegal for state governments to interfere in religious practices without first demonstrating a “compelling interest” in doing so. Byrne: Second-hand fentanyl fumes threaten Seattle bus drivers

The Emerald City is going up in smoke, again. Two years after Seattle officials let the city burn during BLM protests, bus drivers say they’re facing a frightful new danger: second-hand fentanyl fumes spread by addicts brazenly smoking the deadly synthetic drug on public transportation. “The signs are, they put their head down, and start watching for the flame,” Kings County Metro bus driver Erik Christensen told KIRO 7 News. “After they inhale or ingest, they can comfortably pass out. And no one’s going to stop them.” Seattle, like New York City, rarely arrests or prosecutes people in possession of small amounts of hard drugs, even if they’re using them in public. Smoking instead of injecting fentanyl meanwhile is gaining in popularity. The result is bad news for public transportation, drivers say.

(United Kingdom) Van Maren:  ‘Transgender’ males are now pushing for uterus transplants

For several years now, transgender activists have been loudly declaring that biology itself is “transphobic.” A prominent example of why Nature is bigoted is the fact that men calling themselves “transgender women” cannot get pregnant, because, despite their delusions, they do not possess the necessary equipment to conceive, carry, and birth a child. The fact that medical experts have not yet solved this problem is, according to trans activists, more evidence of how the healthcare system is also “transphobic.” Back in 2017 already, U.K. doctors with the National Health Service (NHS) were advocating more research into the possibility that wombs could be implanted into biological men, with one top doctor speculating that the medical field might only be a decade away from being able to pull this off. NHS experts added that when (or if) this became possible, biological men who desire to become female should be able to get a womb at the taxpayer’s expense. Those medical ethicists and feminists who pointed out that this was both insane and would divert badly-needed medical resources from research into diseases like cancer were told to shut up.
