Something is clearly different this Supreme Court term after only two weeks of oral arguments. There is a chippiness in the air that wasn’t overtly present before. The distinction between the left and the right of the Court is still in play, but newly appointed Justice Jackson has had control of the proceedings far more than her fellow justices, and there is a lot of coverage on this topic than we’ve seen before. What does this mean for the rest of the term and for the Supreme Court moving forward? Very possibly a lot. How much does control over oral arguments matter? Some say not at all. Oral arguments, for instance, do not often clearly shift votes. The justices and their clerks have all scoured the parties’ and amici’s briefs going into oral arguments. They all have presumably read the lower court proceedings in the cases. This is enough to at least give the justices a strong feeling of how they will vote in a case before ever setting foot on the bench for oral arguments. […] Even with a potential minimal effect, oral arguments have the possibility of factoring into one or more justices’ voting decisions. Even if they don’t affect votes, they may sway the justices to take a stronger or weaker view on particular issues in the case. If it is a foregone conclusion that votes are going to go down along ideological lines, then perhaps only the policy in the decision is malleable. This is how control comes in. The ability to usurp control over arguments potentially empower justices to achieve these agenda items at the expense of others’ chances to do so. […] Assuming any of the above purposes or others matter to oral arguments and how they play out in votes, opinions, or in policymaking, Justice Jackson has a signaled her willingness to use this pedestal to her advantage. The Supreme Court hears oral arguments on Monday in the twin cases of Students for Fair Admissions Inc. v. President & Fellows of Harvard College and Students for Fair Admissions Inc. v. University of North Carolina, with the plaintiffs in both cases asking the high court to overturn its 2003 decision in Grutter v. Bollinger, which held that institutes of higher education could consider an applicant’s race in making admissions decisions. Here’s your lawsplainer for the cases. […] While the two lawsuits involved distinct laws — the first, the equal protection clause, and the second, Title VI — courts have long held that the protections of Title VI are coextensive with the Constitution’s equal protection clause. In other words, the same standard governs both public and private educational institutions, assuming the latter accepts financial assistance. And the governing standard was established by the Supreme Court in 2003, in Grutter v. Bollinger, when the high court held “that universities may consider race in their admissions processes as part of their efforts to achieve diversity on campus.” […] In deciding that question, the justices will need to consider first whether Grutter was wrongly decided and if so, whether stare decisis compels the court to nonetheless let the faulty precedent stand.

They said the information is on a compact disc containing images of the laptop. “The FBI did not open an investigation into the murder of Seth Rich, nor did it provide investigative or technical assistance to any investigation into the murder of Seth Rich. As a result, the FBI has never extracted the data from the compact disc and never processed the information contained on the disc,” they said.

As Slay News reported, the FBI has failed to hand over the evidence in violation of a court order. In September, a U.S. District Judge for the Eastern District of Texas ordered the FBI to “produce the information it possesses related to Seth Rich’s laptop.” Judge Amos L. Mazzant gave the FBI 14 days to surrender the evidence. However, the deadline passed on October 13 and the FBI failed to surrender the evidence. After the missed deadline, Democrat President Joe Biden’s administration asked for more time to respond to Judge Mazzant’s order. […] Some people suspect Rich was the source of Hillary Clinton and her campaign manager John Podesta’s emails which were obtained by WikiLeaks before the 2016 Election. Rich was killed shortly after the emails were handed to WikiLeaks.

[…] Julian Assange, the founder of Wikileaks, long embroiled in a lengthy effort to avoid extradition to the U.S. from the U.K., has refused steadfastly to name the source of this material but has hinted on Dutch television that it was Seth Rich. He has repeatedly said the Russian government was not the source. Persons familiar with such things have examined the rate of data transmission, inter alia, and concluded the DNC system was not hacked by outsiders. Instead, they contend that the files were copied to a storage device like a thumb drive and transmitted to Assange’s Wikileaks. […] After Rich’s murder, on March 15, 2018, a source provided to the FBI information and material extracted from the computer. The FBI originally claimed it never had possession of Rich’s laptop nor any information from it. Years later (in 2020) after receipt of this material, however, the agency backtracked and admitted it had thousands of files from Rich’s computer. Brian Huddleston sued under the Freedom of Information Act to obtain disclosure of those documents.

Hajicek: The ACLU’s Interpretation Of ‘Anti-Discrimination’ Would Destroy Free Speech
At an Oct. 25 event hosted by Alliance Defending Freedom (ADF), an attorney with the American Civil Liberties Union (ACLU) argued that anti-discrimination laws should be interpreted in ways that restrict the decisions of business owners, even when they have nothing to do with the identity of the customer, an interpretation that gives governments broad power to restrict freedom of speech. The event, “303 Creative and the Future of Free Speech,” featured a panel discussion between ADF CEO and General Counsel Kristen Waggoner, ACLU National Legal Director David Cole, and Notre Dame Law School Associate Professor Sherif Girgis. The discussion was about 303 Creative v. Elenis, a free speech case the Supreme Court is scheduled to hear in December. Lorie Smith, who runs 303 Creative, is a Christian graphic designer who declined to create a wedding website for a same-sex couple. Smith says she based her decision on the message the website would convey, not on the person requesting it. Waggoner is scheduled to argue Smith’s case before the United States Supreme Court on Dec. 5.

Solomon: Congressional Republicans deploy election observers to tight races, investigate irregularities
The effort led by Rep. Rodney Davis, the top Republican on the House Administration Committee, includes investigating how federal agencies are implementing President Joe Biden’s executive order instructing the U.S. government to expand voter registration, along with the training and deployment of House staff as observers under the authority of Congress. Just the News Staff: Wisconsin appeals court outlaws practice of spoiling absentee ballots to vote again
The state’s 2nd District Court of Appeals on Thursday upheld a county circuit court’s directive that ordered the Wisconsin Elections Commission to rescind its earlier instructions issued to voters who wished to void their submitted ballot and cast a new one. That practice, known as “spoiling,” is relatively rare in U.S. voting, though upwards of 33,000 voters in Wisconsin spoiled their ballots during the 2020 presidential election, according to the Associated Press.
