Qualified Immunity is a controversial legal principle that “protects a government official from lawsuits alleging that the official violated a plaintiff’s rights, only allowing suits where officials violated a ‘clearly established’ statutory or constitutional right.” The bottom line for those of us who believe in civil liberties is that Qualified Immunity makes it very difficult to hold public officials accountable, especially police officers even in cases of horrific brutality, and it’s grating to think that this doctrine was invented by the Supreme Court in 1967. There’s a tension between the Bill of Rights, especially the Second Amendment, and Qualified Immunity. We have covered it here at Bearing Arms before, and discussed the downsides and risks to our rights and liberties from this invented doctrine. But there are Very Smart People out there, a couple of law professors, who think that the worst aspects of Qualified Immunity are a fantastic mechanism to undermine the Supreme Court’s NYSRPA v. Bruen ruling and attack gun rights.

Mr. Schumer last week sent a letter demanding that FERC expedite a “strong transmission planning and cost allocation rule” to deliver more “clean power to Americans.” He claims that disagreements among states on permitting new transmission lines and allocating their costs is stalling renewable projects. Under FERC’s current rules, costs of transmission projects are allocated based on which parties benefit from improved reliability or reduced congestion costs. For example, Illinois residents would pay higher electric rates for a new transmission line to move power from a gas-fired plant in Wisconsin to Illinois to maintain reliability.

Wray’s testimony offered ample evidence of an agency in dire need of reform. In the aftermath, Republicans face questions about funding a new FBI headquarters, countering political investigations of American conservatives, FISA renewal, and how to counter Wray’s unwillingness to submit to the legislative branch’s oversight authority over his agency. Most importantly, Republicans must contend with growing calls from the electorate to defund the FBI. Many Republican representatives lack the political appetite to withstand a “defund the police” label from corporate media. I will proffer an alternative option that may appease both factions: Disarm the FBI and force it to partner with local law enforcement agencies for any investigative and enforcement activities. The Unarmed Criminal Investigator The U.S. Office of Personnel Management (OPM) defines a series 1811 “criminal investigator” as one who supervises, leads, or performs work involving planning, conducting, or managing investigations related to alleged or suspected criminal violation of federal laws. OPM similarly defines a lesser-known 1810 general “investigator.” These employees supervise, lead, or perform work involving planning, conducting, or managing investigations. 1810 investigators are unarmed. Their work does not involve criminal violations of federal laws, and they can only make or invoke administrative judgments. […] Empower Local Authorities Of course, unarmed agents can be just as corrupt as those with firearms. So how will a new series 1812 unarmed criminal investigator position diminish the FBI’s ability to investigate and persecute innocent Americans?

VDH: The Wild 2024 Race

Current polls, pundits, and politicos insist that the 2024 race is a sure rematch between former President Donald Trump and incumbent President Joe Biden. It may well turn out that way. But in past election cycles, summer polls 15 months before the general election usually did not mean much. In December 2003, the CBS poll headline blared, “Dean Pulls Away in Dem Race.” Howard Dean would eventually be clobbered by nominee John Kerry. In the Gallup Poll of late June 2007, Hillary Clinton still continued to enjoy her wide lead in the Democratic primary over eventual nominee and elected president Barack Obama.

On the Republican side, Gallup noted of its summer 2007 polls that, “There has been little serious threat to the frontrunner, former New York City Mayor Rudy Giuliani”—who bombed out early in the race. About this time in 2015, Jeb Bush was leading Donald Trump in the Republican primary. Or as CNN characterized their summer poll, “He [Bush] holds a significant lead over the second-place candidate Trump.” By January 2016, the favorite, can-do Wisconsin governor Scott Walker was leading all candidates by a substantial margin as they headed for the Iowa caucuses. There are lots of reasons to believe that 2024 may prove to be the most volatile race in recent memory.

Derek Chauvin did not get a fair trial for the killing of George Floyd. As the liberals like to say, “period, full stop.” We have covered this many times based on what actually happened in the trial, as opposed to the media coverage which was mostly dishonest. Much like the Michael Brown “hands up, don’t shoot” narrative was false, so too was the narrative that Chauvin kept his knee on George Floyd’s neck “for 9 minutes.” […] The problems with the trial, which I watched live and Andrew Branca live-blogged, were enormous, starting with the open threat of violence and rioting if Chauvin was found not guilty. The trial took place in a fortress in Minneapolis with protesters all around, a mob scene which all but guaranteed a conviction no matter what. The trial judge refused to change venue. Here are some of our prior posts demonstrating numerous problems with the Chauvin trial: . . .[…] News reports and headlines indicate Chauvin plans to seek review by the U.S. Supreme Court. But I doubt SCOTUS will take the case. The state conviction is irrelevant to how long Chauvin stays in prison. Chauvin already pleaded guilty to federal civil rights charges and received a sentence approximately as long as he received on the state charges. And even if SCOTUS agreed with Chauvin, that would only mean there would be a re-trial.

Instead, she received a year in prison with credit for time served and five years of probation during her sentencing hearing. he twists and turns of Hunter Biden’s sweetheart plea deal have been hard to follow, but it’s been clear from the outset that, like his business ventures in Ukraine, the deal was thoroughly corrupt. It’s now clear that the agreement was never meant primarily to shield Hunter from future prosecution, but to protect President Joe Biden. In a Delaware federal court on Wednesday, Hunter’s lawyers ended up rejecting a plea deal once it became clear the deal would not confer broad immunity on the president’s son. Although the language of the plea deal has not been released, it was supposed to have Hunter plead guilty to two misdemeanor counts of willful failure to pay federal income tax, as well as enter a pretrial diversion agreement for illegal possession of a firearm. The deal fell apart, however, once the federal judge overseeing the case, Maryellen Noreika, starting asking questions. Here’s how The New York Times reported it:

The judge who blew up Hunter Biden’s plea deal on Wednesday told the noted artist and former Ukrainian energy executive that he must look for a job as part of the conditions of his release. Biden appeared in federal court in Wilmington, Delaware, for what had expected to be little more than a formality after he accepted a plea deal last month settling tax and gun charges. But the agreement collapsed under the scrutiny of Judge Maryellen Noreika. Instead, the 53-year-old son of the president pleaded not guilty to the charges and must now wait for a new deal over his failure to pay taxes and lying about a drug addiction when he bought a gun. In the meantime, he was allowed to go free so long as he stays away from drink, submits to drug tests when requested, and informs the court of any changes of address.

Despite multiple requests from parents, the district has refused to provide the text of the speech: . . .[…] This is not the first time the district has come under fire for trying to influence children without their parents’ knowledge or consent. In March 2022, a report exposed the fact that the district had held a training in which educators were told that “parents are not entitled to know their kids’ identities” and that this information “must be earned” by parents. This revelation prompted a fierce backlash from parents whose kids were in the school district. This controversy raises a series of questions. To begin with, why is the district concealing the content of Puccio’s speech from the parents? If they truly believe there was nothing wrong with his announcement, why not stand tall and defend it? The lawsuit says that the superintendent expressed that he was “proud of the thoughtfulness and intentionality” in how the teacher declared his intention to “transition.” It makes one wonder what these people are trying to hide – although it doesn’t take a rocket scientist to figure it out, does it? […] At the core of this issue is a blatant disregard for parental rights and disrespect for those who are concerned about the material to which their kids are being exposed at school.

Although biopics about great scientists have been a Hollywood staple ever since the early days of the talkies, they pose distinct challenges to filmmakers. How, after all, to make the sight of somebody working out a mathematical problem in his head visually exciting? […] Throughout the film, Nolan allows us to speculate as to whether Oppenheimer was ever really a Party member. But we’re also expected to believe that, whatever his political loyalties were in the 1930s, he absolutely never passed anything to the Soviets in the 1940s. That he was innocent of any such crimes has certainly been Democratic Party orthodoxy since President Kennedy rehabilitated him by inviting him to a 1962 White House dinner and, the next year, selecting him for an award (which, as seen in the film, LBJ presented to him shortly after JFK’s assassination). […] Now, it may well be that Oppenheimer did shake off Communism by 1940, and that he passed secrets to the Soviets only because he sincerely (if naively) believed that doing so was the best way to secure world peace. Whatever the case, none of the evidence of his perfidy finds its way into American Prometheus, or into Oppenheimer, or into any of the numerous legacy-media reviews of the movie that I’ve perused.
