Special Counsel Jack Smith’s latest indictment against President Trump seeks to criminalize political speech and taking incorrect legal advice. Americans of all political stripes should be furious and deeply concerned by the course Smith has set this country on. I have reviewed the new Trump indictment closely, and sadly, it is exactly what we have come to expect from Smith’s team — a highly political document, riddled with legal and factual infirmities. This indictment should have never been brought to a grand jury in the first place. Moreover, its timing, particularly in light of Smith’s statements and actions in the Trump documents case, is so highly suspect that it casts a political pall over the whole case. The Indictment Smith’s indictment contains four counts against Trump. The first, brought under 18 U.S.C. § 371, alleges that Trump conspired to defraud the United States “by using knowingly false claims of election fraud to obstruct federal government function by which those results are collected, counted and certified.” The second and third allege conspiracy to obstruct an official proceeding and the actual or attempted obstruction of an official proceeding, both in violation of subsections of 18 U.S.C. § 1512.

The fourth alleges that Trump committed a “conspiracy against rights,” by knowingly conspiring to deprive Americans of their right to vote and have their votes counted, in violation of 18 U.S.C. § 241. Having read the indictment, having followed Jan. 6-related cases closely, having read extensive news coverage, and having spoken to others with experience in this area of the law, I do not believe any of these charges can fairly be proven beyond a reasonable doubt in front of a fair judge and jury. Additionally, I expect that were this case to reach the Supreme Court, the court would reject Smith’s theories of liability on all or at least some of these counts, as it did unanimously with his prosecution of former Virginia Gov. Bob McDonnell. Smith and his team did a real disservice to the cause of justice by bringing this indictment. 1. Two sets of laws now operate in an increasingly unrecognizable America. Consider the matter of unlawfully removing and storing classified papers. Donald Trump may go to prison for removing contested White House files to his home. So far Joe Biden seems exempt from just such legal jeopardy.

But as a senator and Vice President with no right, as does a president, to declassify files, Biden removed and, as a private citizen kept for years classified files in insecure locations. Biden’s team strangely revealed the unlawful removals after years of silence. It did so because the Biden administration found itself in the untenable position of prosecuting the former president for “crimes” that the current president committed as well—albeit far earlier and longer.

Mahoney: DePerno Charged With Felonies For Investigating Antrim County’s 2020 Election

In what seems to be the latest instance of vitriolic lawfare related to the 2020 election, Michigan Attorney Matt DePerno, and former state Rep. Daire Rendon were indicted by a grand jury Tuesday for allegedly obtaining and tampering with voting machines in Antrim County after the 2020 election. DePerno was charged with four felony counts, and Rendon faces two felony charges. It is apparently against the law now to question elections in the US of A. To clarify, DePerno and his forensic team were granted access to the machines by court order on December 4. DePerno’s lawsuit produced the first forensic exam of Dominion Voting System machines used in the 2020 election. His lawsuit was one of the only lawsuits to review evidence of fraud in the 2020 elections. His case was ultimately dismissed on appeal by a three-judge panel on April 21, 2022. Nevertheless, DePerno was charged on August 1 with undue possession of a voting machine, conspiracy to commit undue possession of a voting machine, conspiracy to commit unauthorized access to a computer or computer system, and willfully damaging a voting machine. Rendon is charged with conspiracy for undue possession of a voting machine and false pretenses.

Anyone can speak out on Twitter. Anyone can pick an avatar and share viewpoints, memes, incendiary ideas. But not everyone wants their online persona, their political perspectives, and the potential backlash to those to impact their daily life. We have seen how one online “misstep” has ruined lives. Districts are trying to sell parents on TK by using school banners, bus bench ads, billboards, and texting and robocall campaigns. The $2.7 billion plan aims to have 400,000 4-year-olds enrolled by 2025, but it has been off to a sluggish start. Estimates from the Legislative Analyst’s Office put average daily attendance for the 2022-2023 school year at about 91,000, well short of Gov. Gavin Newsom’s estimates. The idea of having the government in charge of educating 4-year-olds has been promoted for years. Most recently, in his State of the Union speech in February, Joe Biden asserted that “children who go to preschool are nearly 50% more likely to finish high school and go on to earn a two- or four-year degree.” […] The National Education Association extols the virtues of TK on its website, claiming that children in early childhood education programs are less likely to repeat a grade, less likely to be identified as having special needs, more prepared academically for later grades, more likely to graduate from high school, and be higher earners in the workforce. But all the rah-rah talk falls apart when the data are examined. The U.S. has a near 60-year history of funding early childhood programs in the form of Head Start. […] And now, there is most definitely a risk in allowing the government to help raise young children. A 4-year-old these days may be getting an education about gender identity. The Kaplan Early Learning Center, a widely used international educational services company that provides education and training services to schools at all levels, has lessons on “Gender Identity in Preschool Children,” “Confronting My -isms,” etc., ad nauseam. Along those lines, the Evanston-Skokie school district in Illinois has adopted a curriculum that teaches pre-K through third-grade students to “break the binary” of gender. And they are hardly a one-off.

The de-banking of individuals by major banks is becoming more common and should concern us all. Two high-profile individuals, Nigel Farage, and Dr. Joseph Mercola, are the most recent casualties in the de-banking game. Without warning or fanfare, they were both de-banked by financial institutions; Farage by NatWest and Mercola by JP Morgan Chase Bank. And, by the way, General Flynn, his wife, and our Editor-in-Chief, Tracy Beanz, were also de-platformed and demonetized; Flynn by Chase and Tracy by PayPal. In the cases of Farage and Flynn, the banks “backtracked” or “apologized,” but only after both men used their outsized megaphones to cause a fuss. […] Nebraska’s State Treasurer John Murante wrote in his Newsweek opinion piece in March: “When powerful banks like Chase retain unbridled discretion to cancel accounts for arbitrary or biased reasons, it undermines the freedom of everyday Americans to participate in society and the marketplace without fear of discrimination based on their political or religious views.” Murante’s OpEd covered how banks and corporations seem to target those “holding mainstream American views.” He cites DirectTV’s (AT&T) removal of the conservative OAN network from its listings. Murante also gave several examples of people who have been “de-banked.” General Flynn, the Arkansas Family Council, the Defense of Liberty, and Ambassador Sam Brownback (the National Committee for Religious Freedom (NCRF)) were all on Murante’s list. Kanye West was also booted in 2022 from Chase without notice, apparently for being too vocal about the “wrong” kinds of thoughts.

An official campaign website set up for Houck’s candidacy in the 2024 election states the pro-life dad is running on a “common sense” platform of “Restoring Faith, Family & Freedom.” “I have seen firsthand what an out-of-control government can do to its citizens,” Houck said in a statement published on the campaign website. “I will fight to protect all people and their rights under God & our Constitution. My platform is based on common sense.” Houck said he is “running for Congress to further protect my family, those in the 1st district & the Republic.”

The events of January 6th attracted a lot of opportunists, many of them Democrat politicians seeking to make electoral hay in the aftermath. Unfortunately, some of the opportunists were also in uniform on that day, and perhaps the worst example of that is Michael Fanone. Fanone ended up being one of the star witnesses for the January 6th committee, claiming that he suffered such trauma from the riot that he had to resign from the United States Capitol Police. It was long before he became a regular on liberal cable news networks and a folk hero among those on the far left. Unsurprisingly, he also ended up with a book deal.

Morrison: FDA recalls 350,000 Tydemy birth control pills sold since last June because they might not work

Hundreds of thousands of birth control pills were recalled after the manufacturer found they were ineffective, potentially resulting in an unplanned pregnancy. The Food and Drug Administration announced the voluntary recall of this week of the combined estrogen and progestin pills from India-based Lupin Pharmaceuticals after it was found that the pills had insufficient levels of inactive vitamin C which could impact their ability to prevent pregnancy. The company’s decision to issue the recall affects a total of 4,179 boxes of daily pills, amounting to about 350,000 total. They were distributed nationwide to pharmacies and supermarkets from June 2022 through May 2023.
