Special Counsel Jack Smith has indicted President Trump. Again. To spare you the pain of reading them, let me summarize the recent 45-page “election fraud” indictment and the June 44-page “documents” indictment: in June, Smith indicted Trump for stealing the government’s office paper. In August, he indicted Trump for claiming the 2020 election was fraudulent. Lavrentiy Beria, Stalin’s head of the Soviet secret police, once remarked, “Show me the man, and I’ll show you the crime.” From personally torturing political dissidents to overseeing the massacre of more than 15,000 Polish officers in the infamous Katyn Forest, Beria wrought horrors upon Stalin’s enemies—real and perceived. He kept it up for more than 20 years until, in a predictable irony, fate caught up with him and he was “tried” in 1953. He was shot in the head two days before Christmas. At his “trial,” Beria was not afforded the protections of due process. His was a “show trial.” There are echoes of Beria in Jack Smith; while Trump may be afforded due process, we already know the prosecution is substantively illegitimate. The judiciary abdicates its duty when it tolerates broad-ranging executive “emergency powers.” Supreme Court–watchers who try to see beyond the moment have frequently perceived Justice Elena Kagan as a future chief justice. She comes from a family of civil servants and is unlikely to be touched by financial scandal. As dean of the Harvard Law School, she was a conciliator, respectful of opposing views. Most notably, along with Justice Stephen Breyer, she joined the more conservative justices in the Sebelius Obamacare case in finally placing meaningful inhibitions on the conditional spending power in the interests of federalism. […] But those looking to Justice Kagan as an anchor of essential principles in a crisis must be feeling some disappointment; she joining two so-called liberals in the two cases involving the invocation of vague emergency powers to validate moratoria on rent and student loan payments.

Durden: Pentagon Mulls Placing US Troops On Shipping Tankers To Prevent Iranian Seizure
The Pentagon is pursuing strategic ways to prevent further seizures of international vessels by Iran’s military, particularly in and near the vital Strait of Hormuz and Persian Gulf region. There’s been a series of tit-for-tat tanker seizures of late between Tehran and Washington, as the US attempts crude oil sanctions enforcement against Iran. And now the US is mulling more drastic action, with The Associated Press reporting Thursday, “The U.S. military is considering putting armed personnel on commercial ships traveling through the Strait of Hormuz, in what would be an unheard of action aimed at stopping Iran from seizing and harassing civilian vessels,” per four American officials cited in the report. Some reports now suggest Marines are already being trained for the proposed program.

Transgender journalist from the United States is now an official spokesperson of the Territorial Defense Forces of the Ukrainian Armed Forces. The Kyiv Post on Thursday tweeted that Sarah Ashton-Cirillo “has become one of the speakers for the Defense Forces,” and her work for Ukraine was soon praised in statements from Ukraine’s Ministry of Defense and Hanna Mailar, a Ukrainian deputy minister of defense.

David Brooks is now pondering if progressives really are the “good guys” after all. Wait, you mean the political movement that’s grooming children, censoring Americans, and arresting political opponents “KGB-style,” might not be the heroes, after all? When I began my journalism career in Chicago in the 1980s, there were still some old crusty working-class guys around the newsroom. Now we’re not only a college-dominated profession, we’re an elite-college-dominated profession. Only 0.8 percent of all college students graduate from the super elite 12 schools (the Ivy League colleges, plus Stanford, M.I.T., Duke and the University of Chicago). A 2018 study found that more than 50 percent of the staff writers at the beloved New York Times and The Wall Street Journal attended one of the 29 most elite universities in the nation. David points out the progressive hive mentality of coastal elites who live in a clueless bubble of their own making: . . . And how to shut them down. It is easy to birth conspiracy theories. All that is required is chronic government stonewalling of reasonable requests for transparency. Then add in high officials serially lying under oath, along with the blatantly unequal application of the law. Institutionalize arguments from authority of politicians and bureaucrats who refuse to adjudicate arguments empirically. Include the weaponization of investigatory and intelligence bureaucracies. Finish with the transformation of an obsequious media into a mouthpiece of the state. And presto, you end up with a skeptical, cynical public that learns to believe the very opposite from what it is told by elites.

Whedon: Two Navy service members arrested on suspicion of sending military secrets to China
Authorities detained Jinchao Wei, aka Patrick Wei, on Wednesday and charged him with “conspiracy to send national defense information to an intelligence officer working for the People’s Republic of China,” according to a press release from the Department of Justice. Wei allegedly began communicating with a Chinese intelligence officer in February 2022. That official tasked Wei with providing information related to U.S. Navy ships. At the time, Wei was stationed about the U.S.S. Essex. He allegedly provided the Chinese official with information on the weapons systems of the vessel and also disclosed the locations of other U.S. ships. […] In a separate case, the DOJ charged Wenheng Zhao, aka Thomas Zhao, for receiving bribes in exchanging for sending information to a Chinese intelligence officer, who had masqueraded as a maritime economic researcher. Zhao’s passing of materials to the Chinese official began in August of 2021 and ran through at least May of this year.
