Legal Expert: ‘Garland’s Indictment of Trump Is Political’
The full and latest indictment of Donald Trump has dropped, and leftists are saying for the 23 millionth time how they’ve really got him this time. Article III Project founder and president Mike Davis begs to disagree. According to him, this is yet another witch hunt of the deranged and justice-allergic Left.
To begin with, Davis listed four key points to argue the indictment and its timing are politically partisan, in a Twitter thread:
“Indictment confirms Garland’s indictment of Trump is political:
1. Presidential Records Act, not Espionage Act, controls former president’s handling of his presidential records
2. Generally, legally impossible to obstruct investigation into non-crime, per binding 2019 OLC memo
3. The theory the President of the United States can declassify information and still get charged for espionage–under ‘national defense information’–will not survive Supreme Court review.
4. The timing of this indictment proves it’s political:
Garland indicted Trump the day after we learned the FBI covered up evidence since 2017 then-VP Biden and his family took at least $10 million in foreign bribes and changed U.S. policy.”
Davis later added, “Dear Legal Commentators: Former presidents (like Clinton and Trump) aren’t low-level DoD employees. Or even former vice presidents (Biden) or secretaries of state (Hillary). Presidential Records Act, not Espionage Act, controls.” In other words, Trump could declassify documents and take them to other locations. Unlike then-Vice President Biden, who illicitly stored classified documents in various unsecured locations, like his garage.
We all know what this is. It’s meant to distract from the evidence of Joe Biden’s multi-million-dollar bribery scheme, while simultaneously trying to remove Trump from the 2024 presidential race. It’s more banana republic nonsense. But what else can we expect from Joe Biden’s “Justice” Department?
